How to file case of ESTAFA

How can i file a case of estafa if I'm from Cebu and the accused is from Cubao. I already send her a demand letter, all the check that she issued are dishonored by the bank reason account closed. We have also written agreement notarized. What should be my next step to get my hard earn money? By the way im not the only one gave her a loan, i think 20 of us investors got the same scenario. Can we file a case as ONE? or Should i fly to manila and file a bymyself to the prosecutor office of QC. One more thing if i can't go there to manila is it possible the lawyer that will represent me can file a case in my behalf or even my brother who lives in manila..thanks & regards

why not file it in cebu? didn't any transaction occur there? weren't the checks received there?

the transaction occur thru emails & online forums the written agreement together with the pdc where ship thru LBC and deposited here in CEBU. Is it possible to file a case here in Cebu even if the accused live in manila?

if for a civil case for collection, definitely it can be filed there.

for bp 22, i believe it will prosper in cebu because your receipt of the check was in cebu, but you will have to prove that the issuer of the check received a written notice that the checks were dishonored.

Thanks for replying AttyLLL, I sent the demand letter thru registered mail stating all the check # & xerox copy of the dishonored check. If I file a case BP22 in cebu how can they force to the attend the hearing? in case the court issue a subpoena they might easily ignore it because of the distance.

you can't force them to attend. it will be at their risk if they do not.
