Hello po. Sana matulungan niyo ako.

Bumili po kasi kami ng House and Lot at kakatapos lang namin mabayaran yung 10% na downpayment. Pero sa kasamaang palad, nagkakaproblema kami sa pera kaya di kami nakakakuha ng Loan sa mga bangko kaya sa ngayon, In-House yung binabayaran namin na sobrang mahal.

Dahil po dun, iniisip ko po na iforfeit nalang yung pagbili ng house and lot since baka lalong magkaproblema kung ipipilit naming bayaran yun.

So ang tanong ko po, if maforfeit nga po namin yung pagbili, may matatanggap po ba kaming refund? Nabasa ko po kasi sa internet nang naghanap ako about sa pagforfeit ng house and lot is that makakatanggap po kami ng 50% na total na nabayaran as refund [Real Estate Law]. Di ko po sure kung applicable sa case ko yun.

Pero natanong ko na din sa account officer ko na if maapprove daw yung refund, 10-20% daw matatanggap kong refund.

So, ano po ba talaga ang percentage na matatanggap kong refund if sakaling iforfeit ko siya?

Tanong ko po ulit...

Natapos na po kasi naming ang 12 month downpayment para sa house and lot... at magdadalawang buwan na kami sa in house payments meaning... near 14 months na kami sa pagbabayad...

Ang sabi sa Maceda Law po ay qualified lang dito ang 2 years na nagbabayad... pero may sinabi din po na:
"Under Section 4, on the other hand, a qualified buyer is also one who has purchased any of the properties enumerated above, but who has paid less than two years of installments."

So, qualified po ba kami dito kahit 14 months palang? residential po siya na house and lot.
