it depends. if they have sufficient proof to show that this person was the cause of this incident then the person can be liable.

again, it will depend on the complainant what type of case they will file against this person.

as for the deceased was the one who instigated, this will be tackled on the case proceeding and the court will be the one to decide the merit of the allegations and evidences. you cannot stop someone from filling a case as this is their right. the only question is if the case will prosper if the allegations are baseless.
