Greetings!

First, I'd like to let you know I am grateful you have this website to help and guide a lot of people regarding legal matters.
I am a single mom and my daughter is 14 years old. I was married to her father. He has been gone missing for 9 years now. Has abandoned my daughter for 9 years as well, not a single penny of support.
I raised my daughter alone and now, I'm trying to give my daughter a better life abroad, unfortunately, the immigration wants a document from the court stating my full custody. Please help me and guide me what legal process should I take. Can I file both together abandonment and full custody? Can the Philippine Attorney's Office help me out without having to pay a lot Sad How long does the process take.
I can't afford annulment Sad
All I want is to give my daughter a good future. Thank you.

The father has been missing for 9 years. We can no longer find that man. Even his parents and relatives doesn't know where he is.

You may file the petition for the declaration of your husband to be presumed dead. That way, you could have sole custody of your child. But you just have to make sure that you cannot locate the father anymore, like di na makita sa internet, sa dating tinirhan, etc.

Regarding your question about free legal services, are you gainfully employed abroad? You might not qualify as indigent to be able to seek legal aid from the Public Attorney's Office.

A declaration of presumptive death petition entails a that the petition be published, on top of court costs and filing fees.
