Hi to all, I want to ask if pwede ako gumawa ng kasulatan na nagsasaad na lahat ng properties namin magasawa ay mahahati 50/50 if ever we get a legal separation. Worried lang ako kasi nasa abroad ako and me mga business ginawa ang asawa ko na sa kanya lang nakapangalan

Did you have a pre nuptial agreement?

Are you legally married? Because if you are legally married and you got married after August 3, 1988 there is no need to draft an agreement like that. Under the law, all earnings during the marriage and everything you bring in to the marriage is community property save for a few exceptions - husband and wife own 50-50 share and share alike.

(1) Property acquired during the marriage by gratuitous title (by donation and by testate/intestate succession) by either spouse, and the fruits as well as the income thereof, if any, unless it is expressly provided by the donor, testator or grantor that they shall form part of the community property;

(2) Property for personal and exclusive use of either spouse. However, jewelry shall form part of the community property;

(3) Property acquired before the marriage by either spouse who has legitimate descendants by a former marriage, and the fruits as well as the income, if any, of such property.
