Ayaw i-refund ng supplier ang downpayment para sa order na hindi nila ginawa

Arresto Menor

Bale ako po ay nagbebenta ng customized bags (wholesale)
Ang aking supplier ay sa divisoria.
Recently, nagorder ako ng worth P15,000 na bags.
Ang down payment is 50% so P8000 ang aking dineposit.
Pero hindi nila nagawa ang order ko and walang reply sa text or call.
Finally, nung nakausap ko na ang supplier, hindi raw nagawa dahil akala wala pang dineposit.

Dahil galit na ang customer ko, rinefund ko nalang sila. So humihingi ako ngayon ng refund since wala pa rin naman silang nagawa pero ayaw nilang ibigay.
Ang problema, wala kaming contract dahil usually sa call lang ako nagoorder (Sa Pampanga pa kasi ako) at ilan beses ko na rin silang nakatranstact.
Dati na rin akong bumibili sa divisoria, specifically sa juan luna pero ngayon ko lang naencounter ito.

Meron po bang possible legal action para dito?

You say "recently". How long time since you ordered?

Supplier have right to SOME delay
(if no date demand is said in the deal. Even if it's said in the deal, the can be some "force messure" = out of their control as for instance typhon).

But if they don't deliver within reasonaböle time, you have right to get your money back.

Check if they say something about it in their delivery rules. You have "agreed" to them by sending the order.
