problema.po ng mag-anak,,,. si A po ay ang dating tenant ng lupang sinasaka ngayon ni B dahil namatay na c A. Si  B anak ni A na ang tumuloy sa pagsasaka for more than 16 years na. Pero meron taong si C.sabihin na natin n siya c dela cruz ang nagsasabing sila ang may ari ng lupaing iyon.. pero ng tiningnan ni B sa registry of deeds ang original OWNER ay si Magpantay at itong si dela cruz ay cancelled as owner.. ngunit itong c B ay siya rin ang nagbabayad ng taxes from the very start under the original name of owner subalit itong si C (dela Cruz) ay hinahabol niya ang lupa at binili niya ang lupa sa 2 anak ni A at ng asawa sa halagang Php 175k na hindi naman sila ang nagsasaka. Pumirma ang 2 anak ni A. na hindi naman napayag ang ibang anak ni A. ngunit pineke ng anak ni A ang pirma ng kanyang mga kapatid.. ano po kaya ang mangyayari ditto.. salamat po..

Good morning po. Binebenta ko po ang family house namin ang problema po hindi po namin siya naipatranfer sa name namin agad ng ibigay ng developer and owners title cert,deed of sale,contract to sell at cap gains na binayarn ng devloper 2013 po namin nakuha ang mga documents sa developer ngaun po gusto namin ibenta at may willing na bilhin ano po mga papers ang dapat namin i provide ? At wala po ba mqgiging problema?
Babayaran po namin whatever penalties from bir.
After po ba mabayaran ang penalties and pay the capital gains ano po ang next step?
Salamat po.

After executing the deed of sale paying all the taxes for the second sale (since it appears that the taxes for the first sale were already paid for) you should go to the Register of deeds to have the title cancelled and a new one issued in the name of your buyer.

Who should bear the payment for Tax Declaration/Return? is it the seller or the buyer?
