Hi everyone. I would like to inquire if my marriage is valid considering that I used a different surname in my marriage certificate - a surname that's completely different from the surname that's in my birth certificate?

In my birth certificate, I have my father's last name.

Example: Jane Doe.

But I never used my father's last name ever. I used my mother's last name in every document and ID I have.

So when I got married, I used my mother's last name as my last name.

Example: Jane Smith.

So I married my husband as Jane Smith and not as Jane Doe (my legal name)

Husband and I have been separated for 6+ years now and I'm wondering if that marriage was valid or not.

When I requested for a CENOMAR for my real name; Jane Doe (with father's surname), it says that there is no marriage record found for Jane Doe.

But there is a marriage certificate between Jane Smith and husband.

Does that mean that my marriage was null and void? Because my husband married Jane Smith and Jane Smith does not exist in the statistics because my real name is Jane Doe?

I've read articles that typo errors do not make a marriage invalid. But in my case, there is no typo error. I used a different LAST NAME.

What do you guys think? I would like to have this marriage declared null and void. Is this enough grounds for a petition to make sure it's invalid?

it is still valid since you (what ever name you used) got married to your husband.

this is not sufficient to declare a marriage void.
