Arresto Menor

Hi, i am the complainant for violation of ra 9262. I have received the subpoena to appear on March 27. My questions are:

1. How will I know if the respondent received the subpoena? The main address i gave was his home address. He is not home most of the time and he is the only one living there. When i filed the complaint i stated to send the subpoena also to his office. I saw that his office address was put under the home address preceded by c/o. Would the subpoena be sent also to his office address?

2. What if he ignored the subpoena and didnt appear on March 27?

3. When can a warrant be issued?

4. Does he already have a HDO?

5. How much is the bail? What is the probability that he can be put to jail. Ive suffered physical injuries and submitted medico legal cert.

Hi,

1. The prosecutor will know if he had received the subpoena. So, don't worry about it.

2. If your complaint is still in the Prosecutor's Office and depending on whether there is another date is he required to appear before the prosecutor, then the Prosecutor will issue a resolution based on the evidence you've provided.

Pero if your complaint is already filed in court, if he doesn't attend a court hearing, then a warrant of arrest will be issued by the judge.

3. When can a warrant be issued?

A warrant of arrest can be issued when the complaint is already filed in court and the accused fails to attend a court hearing.

4. Does he already have a HDO?

HDO is not automatically issued, you have to ask for it, through your lawyer.

5. How much is the bail? What is the probability that he can be put to jail. Ive suffered physical injuries and submitted medico legal cert.

Ask the prosecutor.
