Good day.

Hihingi lang po sana ako ng konting advise or insight tungkol sa pagkakadismiss samin from our former company. I/we worked for the company for 6 years, the incident occurred last january (return to work from xmas vacation).

the scenario was like this, last dec maaga ang naging bakasyon namin (dec 16) before we left the office we were told na january 9 na raw pasok namin kasi halos wala pang gawa sa production namin. they even told us na ittext nalang daw kami if ever mapaaga or medyo malelate pa ng onti ang return to work date.

come january 9 walang text or any sort so naisip namin baka medyo mamove pa ng onti dahil wala pa talagang gawa. my co workers pm'ed me that they were texted by the HR na papasok na sila. nagtaka ako bakit ako wala eh january 11 na. i was bother so i came to our HR's house to ask her personally. to my surprise she told me na i wont be longer working for the company " babayaran nalang daw kami" and she even said that the company will be paying us for the january month to be considerate enough.

since we where hired aug 2010, kung nagpatuloy pa kami the company should be paying us 7 years since its our 6th month on the end of january.

me and my colleagues decided to file a illegal dismissal case to DOLE come 2 sena's they didnt showed up so we decided to elevate it to nlrc.our first sena ill be on March 8.

the office was claiming that they "noticed" us (which the truth is kung hinde pa ko nagpunta hinde ko malalaman) as far i as i know the notice SHOULD be filed or to be served 1 month before your last day of work.


tapos yung sinasabi nilang 1 month pang sinasabi nila na ipapasahod samin bigla nalang isasama nalang daw sa lastpay namin.

gusto ko lang po sana malamang in behalf ng mga kasama kong nagfile kung malaki ang habol namin dito?

kung meron man kaming habol panu po ba ang magiging takbo nito aside syempre sa arbitration syempre hinde kasi namin alam kung anu ang dadaanan namin dito. nagpauusapan namin lang ng mga kasama ko na kung aareglo man sila magpapaareglo nalang kami para wag na tumagal to since hinde naman kami mayayaman para maghold up ng matagal dito sa kasong to. most of us hinde na makapagtrabaho dahil sa kasong to.

kami po ba dapat ang magdikta ng tungkol sa danyos?or ang arbitrator?

salamat po ng marami sa sasagot.

kayo ang magdidikta ng danyos at ang arbiter ang huhusga kung karapatdapat kayong bigyan ng ganyang amount.

mga impt na tanong.
1. kayo ba ay natanggal sa trabaho? (termination notice) kung walang patunay pwedeng i claim ng companya na sa ngayon kayo ay merely on floating status kaya no illegal dismissal.
2. anong rason at kayo ay tinanggal? redundancy etc (dito mag base ang computation ng separation pay)
3. willing pa ba kayong bumalik sa trabaho? isang possibleng maging decision ng arbiter ay ibalik nalang kayo sa trabaho

yes tinggal po kami. actually, 13 kami dati ngayon 5 nalang kaming tumuloy sa kaso the rest nagdesisyon nalang sila na kunin kung anu yung binigay ng kumpanya para makapasok na sila sa ibang company.at wala na rin silang kapera pera. tungkol sa notice wala pong any written notice prior or on the day na sinabi na wala na kaming trabaho.ouro verbal lang..

reason? yun na nga po, ni wala kami alam na rason kung bakit.. pero sa main office namin kasi sa alabang, (we are on the plant in carmona) sa main namin nagbabawas na sila ng tao dahil lugi daw "daw". pero sa kanila kasi nasa ayos lahat, oofferan ka muna, then maguusap kayo whether you like it or not. if you agree bibigyan ka na ng notice na isang buwan ka nalang which the right process.


ayon sa mga nakakuha na ng mga sep pay nila, 27 days (1 month) per year ang binayaran sa kanila then kinaltas ang mga existing loans.


reinstatement? we wont prefer reinstatement maliit lang ang company premises and its like sleeping with the lions dun.kilala pa naman ang magkapatid na nasa taas sa pagiging terror. sisigawan ka kung kelan nila gusto. ang isa naman hahamunin ka rin ng suntukan.

gusto lang namin sila bigyan ng lasa ng batas dahil matagal na silang ganyan. naaawa lang kami sa mga susunod pa samin.

kung binibigay na yung 27 days per year dapat tinanggap nyo na. Nakipagsapalaran pa kayo sa complaint eh you wont get more than that if you win. Or sa iba lang ba binibigay ito at sainyo ayaw kayo bigyan ng separation pay kaya kayo nag file ng complaint?

nagnotice sila na ready na raw ang sep pay namin after several weeks after namin mag file ng complaint sa DOLE..hinde na namin muna pinuntahan sa office kasi kung may laban kami mababalewala lang lahat ng inantay namin kasi kelangan namin pumirma ng quitcliam/release papers.

lahat naman daw binigyan ng 27 days eh.

so you mean theres no sense to push this thru?

and saying so, pwede nalang nila bawiin ang 27 days namin at gawing 15 days?



and so wala na po ba sense para ilaban ang illegal dismissal since we wont be agreeing for a reinstatement?

in my opinion wala. If ibibahin nila to 15 days, dapat may compelling reason. Its probably bec of the reason for termination. If matalo kayo sa kaso wala kayong makukuha (but malakas ang chance nyo). pero matagal pa na process and hindi pa sigurado.
