Hihingi lang po sana ako ng konting advise or insight tungkol sa pagkakadismiss samin from our former company. I/we worked for the company for 6 years, the incident occurred last january (return to work from xmas vacation).
the scenario was like this, last dec maaga ang naging bakasyon namin (dec 16) before we left the office we were told na january 9 na raw pasok namin kasi halos wala pang gawa sa production namin. they even told us na ittext nalang daw kami if ever mapaaga or medyo malelate pa ng onti ang return to work date.
come january 9 walang text or any sort so naisip namin baka medyo mamove pa ng onti dahil wala pa talagang gawa. my co workers pm'ed me that they were texted by the HR na papasok na sila. nagtaka ako bakit ako wala eh january 11 na. i was bother so i came to our HR's house to ask her personally. to my surprise she told me na i wont be longer working for the company " babayaran nalang daw kami" and she even said that the company will be paying us for the january month to be considerate enough.
since we where hired aug 2010, kung nagpatuloy pa kami the company should be paying us 7 years since its our 6th month on the end of january.
me and my colleagues decided to file a illegal dismissal case to DOLE come 2 sena's they didnt showed up so we decided to elevate it to nlrc.our first sena ill be on March 8.
the office was claiming that they "noticed" us (which the truth is kung hinde pa ko nagpunta hinde ko malalaman) as far i as i know the notice SHOULD be filed or to be served 1 month before your last day of work.
tapos yung sinasabi nilang 1 month pang sinasabi nila na ipapasahod samin bigla nalang isasama nalang daw sa lastpay namin.
gusto ko lang po sana malamang in behalf ng mga kasama kong nagfile kung malaki ang habol namin dito?
kung meron man kaming habol panu po ba ang magiging takbo nito aside syempre sa arbitration syempre hinde kasi namin alam kung anu ang dadaanan namin dito. nagpauusapan namin lang ng mga kasama ko na kung aareglo man sila magpapaareglo nalang kami para wag na tumagal to since hinde naman kami mayayaman para maghold up ng matagal dito sa kasong to. most of us hinde na makapagtrabaho dahil sa kasong to.
