Immediate Resignation, Company asking for Payments

Hi.

I recently worked sa isang school. I decided to resign immediately due to the ff: 1) Sobra akong na-hurt sa sinabi ng boss ko sakin. I really had an emotional breakdown afterwards. Sobra ako nadegrade na para bang wala akong pinag-aralan at lisensya. 2) Health reason. Mula ng mag-stay ako sa office ko, di na ko nawalan ng rhinitis (bago lang kasi yung bldg ng school so, sobrang alikabok). Sobra na ko nahihirapan huminga everyday. 3) I decided to enrol sa grad school.

Now, nagpasa ako ng letter. They're asking me to render 60 working days. Since nag-enrol na ko sa grad school, I cannot do it. And, hindi ko na talaga kaya makisama sa boss ko. So umalis ako. Nung bumalik ako para i-try magclearance, pinagbabayad nila ako ng 54,000.00+. Ayun kasi yung nasa contract. They already hold my salary which I think a month salary (2 cut-off period, Jan 16 kasi ako nagresign).

So, should I really pay it for me to get a COE? Kinakabahan kasi ako na baka pag nagapply na ulet ako sa work at hindi ko i-declare na nagwork ako sakanila eh matanggal ako.

well yun ang nakasulat sa contract so yun ang tamang bayaran. pwede mo ilaban and try mag file ng complaint sa DOLE but if natalo ka di ka na talaga makakuha ng COE

I beg to differ.

Every employee who became part of a company, whether the latter filed a complaint or not and whether the latter won or lost that complaint, that employee has every right to a COE. Hindi po basehan ang pagsampa ng complaint, matalo o manalo, ang pagbigay ng employer ng COE. although not specified int he Labor Code, a COE has now become a DEMANDABLE RIGHT.

if he files a complaint sa DOLE because the company refuses to give him a COE and DOLE rules against him eh di pano sya mag demand kung natalo nga? i understand your point but if someone files a complaint that he wasn't given his salary and he loses the complaint how can he demand to get his salary eh he lost nga?

I agree.
Kailangang bigyan ka ng employer mo ng Certificate Of EMPLOYMENT lalo na't nagtrabaho ka naman talaga sa kanila, katibayan lang naman yun ng tenure mo sa company regardless kung may "issues" ka with the company or what. Siguro matatalo ka sa case if di ka naman talaga nagtrabaho sa kanila, same goes with the salary. Kung mapatunayan naman na dapat talagang ibigay sayo yung salary syempre ibibigay, kung hindi, hindi talaga.

At kahit naman may hawak kang COE, pwede namang mag background check yung papasukan mong bago. Dun na yun malalaman

I believe you and I were referring to the COE before and NOT the salary of the employee.

yes sorry, my apologies if the example i used became confusing. My point is, if the company refused to issue him a COE and he files a complaint because the company refuses to give him a COE and he loses that complaint, then how can he demand pa, eh he lost the complaint/case nga

The DOLE can compel the company to issue the employee because, again, COEs are a demandable right.

If this can't be facilitated by the DOLE or if the employee loses the complaint (which is improbable), the latter can always appeal up to the Supreme Court, if he so chooses. And unless the Supreme Court decides that the employee is not entitled to it, the employee can then keep quiet.

nag file po ako ng resignation letter may 10, 2016 thrue email lang po, pero ni isa po sa mga boss ko walang nag reply sa email ko. ngayon po after 9months ngayon lang po sila sumagot. pinag susubmit po nila ako ng hard copy ng resignation letter ko plus i settle ko daw po yung accountabilieskto na textpad. willing naman po ako na i settle yun. kaso ang problema may mga other charges sila na pinababayaran pa po sa akin like yung personal na utang ko sa co-worker ko. ang tanong ko po kailangan ko po ba i bayaran yung sinasabi nila na sa co worker ko, its not na company issue naman po iyo. ang i sesettle ko lang po ay yung textpad na accountabilies ko. magbibigay pa rin po ba sila ng COE sa kanya or i hohold nila ang COE ko hanggang hindi ko na settle yung sa co worker ko na sinasabi nila.?
