Annulment? Or not?

Ang pinsan ko ay 20 yrs old (lalaki) nung xa ay Kinasal sa huwes 9 years ago that time he was just 20yrs old. After 3 years na pag sasama nag hiwalay sila. During the time na nag hiwalay sila Hindi pala registered ang kasal Nila dahil vinerify namin ito sa munisipyo Pero walang record. 2015 October ay nagulat nalang kmi ng kuMuha na xa ng cenomar naka lagay na registered ang kasal Nya ng October 1,2015. Pero during September 2015 NASA Dubai sya.
Ang tanung ko po ay Kung may magagawa po ba sya na action para mapa walang bisa ang kanyang kasal? Dahil sa ngayun ay 7 years na po talaga silang hiwalay at hnd nagsasama. Let me just add that he was not able to get his parents sign anything during the time he got married.

Kung registered na yung kasal, wala siya choice kundi mag file ng annulment.

may 2 anak, 2005 and 2007, then we got married 2010 .
unfortunately hindi na tlga kaya iwork out un marriage.
he had several mistakes ng paulit ulit, then nasaktan niya ako nasampal. may pambababae.

now, i have a partner, he got me pregnant, he will be leaving for US soon, petition.
questions:

is it ok to use his surname for our baby? will it affect his petition papers?
how do i file annulment? wha grounds i should use?
