Gd day po. Bago lang po ako sa site na ito, naghahanap po ng kasagustan sana po matulungan nyo po ako. 1985 po nagkaroon ng verbal agreement ang asawa at mother in law ko sa lupang humigit kumulang na 250 sq m, na tumira kami at magpatayo ng bahay. Pamana lang po sa mother inlaw ko ang lupang nabanggit at nakaregister pa sa lolo namin ang tax declaration. ( Scenario po patay na lolo ko na may ari ng lupa na nakapangalan ang tax declaration ,mother in law at asawa ko patay na rin). Wala po akong pinanghahawakang papeles na maliban sa verbal na kasunduan ng asawa ko at mother inlaw ko noong panahong iyon. Nakautang ang mother inlaw ko samin sa halangang P20,000.00 at ang ginawang kabayaran ay yung lupang kinatitirikan ng bahay namin sa ngayon. 26 years na po kami nakatira sa lupang iyon at nabayaran po ang buwis from 1971-1977 lamang noon 2002, this month po planong ko pong iupdate at bayaran ang baring buwis. Tanong ko lang po:
1. Ano po ba ang proseso para maitransfer sa akin ng tax declaration ng lupa o ano po ba ang dapat kung
gawin tungkol dito?
2. Bale 5 magkakapatid ang mother in law ko, na 1 n lang ang buhay, paano po kung may naghahabol
pa na mga pinsan ng asawa ko? May karapatan pa bo ba cla maghabol?
3. Posible po ba pabayaran pa sakin ang lupang iyon kahit na nagkasundo na ang asawa ko at nanay nya
sa halagang nabanggit? Kung pabayaran po pwede po ba na kung magkano ang kalakaran noong 1985
e yun na lang ang pagtibayin?

is there anyone claiming that you are not the owner?

a verbal agreement is valid between the parties, but cannot bind anyone else. is it possible to get all other heirs to sign a document recognizing that you are the owner of that property. that way you can use that document to defend it in case someone claims otherwise.

to properly transfer the property to you, there will have to be settlements of the estates of the dead previous owners.

kapatid at pinsan ng asawa ko.

Pwede sila pumirma sa kasunduang bibilhin pa namin yung lupa, pero as previous agreement they did not recognized, what shall I do?

Sino ang dapat namin papairmahin sa settlement of the state? Pano kung ayaw nila pumirma? pano ko maitransfer anng lot sakin?

convince them to voluntarily execute the documents.

if they do not, your remedy is for quieting of title, but with only possession and no other proof, i doubt your case will prosper.
