Magandang araw po... ako po ay bunso sa 3 anak ng aming tatay. Ang tatay at nanay ko po ay may lupa at bahay na kanilang gustong ibenta. Sa loob po ng pag aaring ito ay pinatitira nila ng walang bayad ang amin pong kapatid na lalaki at ikalawa. Ang nanay ko po ay pumanaw kamakailan lamang habang nag aantay po ng buyer ng property. Sa kasalukuyan ay mayroon pong interesado sa property,ngunit kami po ay nagkaka problema sa aking kuya na nag sabi pong hindi siya aalis kahit na ito ay mabenta. Ang property po ay verbal na nahati hati sa apat (kming 3 magkakapatid at sa tatay ang ika apat) nung nabubuhay pa.si nanay. Ngayon po si tatay po ang nag dedesisyon at namamahala ng pag bi benta. Sa totoo lang po, ako po ang nakapagpagawa ng bahay, sa akin din po nanggaling ang perang ibinayad sa NHA dahil po sa akoy nakapangibang bansa. Ang gusto nga po ng nanay at tatay na ako ang may malaking bahagi pero sinabi ko na pong hatiin na lamang sa apat. Matanda na po ang tatay at ang gusto ko po sana ay mai ayos sya bago ako umalis. Gusto ko din po sanang mapakinabangan nya ang kanilang naipundar sa kanyangbkagustuhan n mag downgrade. (Sikreto ko n pong sinabi sa tatay na ang parte na para sa akin ay kanya na ring gamitin sa pag lipat at pagdowngrade). Ano po ang legal na katayuan namin ni tatay sa ganitong sitwasyon? Ang ayoko pong mangyari ay mabili ang bahay at totohanin nya ang sinasabi ng kuya n hindi sya aalis na kasalukuyan n pong dinadamdam ni tatay. Wag po sana ninyong isipin n ako ay may personal na interes. Angvakin pong interes ay ang kapakanan ni tatay na nasa pangangalaga ng aking mga pamangkin na anak ng aming panganay (ate). Ako po ang tumutustos sa pang araw araw na gastusin ni tatay, kuryente at tubig sa buong property (kasama ang sa kuya) wala po kaming hinihingi at di din binibigyan ng kuya o ng ate ko. Ito pong property ay posibleng maging dahilan ng pag aaway ng ate at kuya kung sakaling si tatay ay pumanaw din. Kaya po sana ito ay gusto na naming ma settle habang si tatay ay may kakayahan pa.

Asuming your parents owned the property equal together. Did they?

After your mother died, then your father have a bit over half = 5 / 8
and you children own 1 / 8 each.

To sell, all need to agree in writing*. And an Extra judicial process is needed to establish who are owners by inheritance.

*It's sure like that after BOTH parents are dead, but I DON'T know for sure if your father can have the right to decide to sell and give you children your shares,

Thank you for replying really appreciate it....
To clarify, the property was acquired by both however, there is no legal document that states the percentage of their ownership. My sister & I just assumed that they acquired it together so its theirs and they (parents) alone have the right to decide on what to do with it.. which they verbally done and acted on before my mothers death.
1. Does this mean that my father doesn't have the right to continue selling it on his own? 2. Do we (all) still need to have this agreement on writing even though it is now soley our fathers property? 3. If the sell was made and done; does my brother have a legal claim to stand on (as he's threatening on staying) or he can be legally told or persuaded to move out? (hopefuly the latter by dad and not the new owner cause it will be unfair for them to be involve with our family issue).

Well. It ISN'T solely your father's, since your mother died, because then you children inherited 1/8 each and your father 1/8 plus the half (=4 / 8 ) he owned allready.
I don't know if your father have legal right to DECIDE.You children have right to 1/8 each anyway IF selling.
(I know ALL have to agree AFTER your father has died, but that haven't happened yet, so I don't know.)

The selling isn't proper done anyway, because I suppouse no Extrajudicial process is done, but it's common such are NOT done, which make there are a lot of messes concerning who own the properties   Smile
