To clarify, the property was acquired by both however, there is no legal document that states the percentage of their ownership. My sister & I just assumed that they acquired it together so its theirs and they (parents) alone have the right to decide on what to do with it.. which they verbally done and acted on before my mothers death.
1. Does this mean that my father doesn't have the right to continue selling it on his own? 2. Do we (all) still need to have this agreement on writing even though it is now soley our fathers property? 3. If the sell was made and done; does my brother have a legal claim to stand on (as he's threatening on staying) or he can be legally told or persuaded to move out? (hopefuly the latter by dad and not the new owner cause it will be unfair for them to be involve with our family issue).
