HELP! COMPANY DONT WANT TO PAY 13th MONTH PAY and BACKWAGES

Good Day Sirs and Madams,

I would like to seek your insights and counsel please.

I was working at KybotechPh Ltd. for 2 years (August 28, 2014 to October 12, 2016) until I resigned. I am an Operations Manager there from August 28 to September 12, 2016. and was a Logistics Manager from September 12 to October 12, 2016.

I resigned because of the characteristics of my boss (MEAN and BULLY). Hindi ko na sya kayang pakitunguhan at yes, naghanap nako ng ibang trabaho bago pa ako nagresign.

At first ayaw nila tanggapin resignation ko but i was so adamant to leave. They told me I need to render 30 days but I said I couldnt as I have a new job (di pa naman ako nagstart agad sa new job) and I dont want to anymore. (Sobra na kasi sya manglait at mamahiya, I have screenshots of our conversations na pwede kong gawing ebidensya). Sabi ko I can do 15 days only.

After marinig ng Ex-Boss ko yung mga sinabi ko na ayaw ko magrender ng 30 days, he said he wont pay my 13th month and backwages. ALSO, he called our Company Security Guard to escort me out kahit wala naman po akong ginagawang eskandalo. Sobrang napahiya po kasi sya kasi sabi ko he is so mean and I coudnt stand him anymore.

My questions sirs and mams:

1. Ayaw po ako bayaran ng boss ko sa full 10 working months as 13th month pay ko. Ang pinapalabas nila now is babayaran nila ang 13th month ko BUT for the new Contract ko po as Logistics Manager which is just 1 month (September 12 to October 12, 2016)

May laban po ba ako if ipapa position paper ko na ho? Nag 1st hearing na kami sa NLRC and matigas po sila na ayaw ako bayaran..

dapat meron. best ask the arbiter kung may laban ka. they will usually tell u or if dapat makipag settle ka nalang kasi weak case mo. ang nakikita kong problema is hindi ka nag render ng 30 days but that isnt reason enough to withhold 13th month pay

Ano ba ang sinabi mong dahilan sa sulat mo kung bakit ka nagre-resign?

Depende rin dyan kung pwede kang ihabla for breach of contract, etc.

Ang sumbat ko po sakanila is Article 285:

Wherein I am being treated inhumane by my employer hence affected my work. For that I am not liable to render for 30 days sir. May mga screenshots po ako ng mga conversation naming dalawa na ebidensya. At may willing mag testify at tumulong saking mga previous employee which were treated the same, kasi hindi lang po ako ang ginawan nya ng ganito, madami pang mga employees.

And I strongly told him that I do have them and I can show them to DOLE/NLRC/COURT. Kaya po sya mas nagmatigas na ihold ang mga backwages ko.


Ang depensa po nila sakin is I breached the contract.

Bali ang laban po is Me (Article 285) + Moral Damage (Was escorted by Security Guard kahit di naman kailangan) vs. Company (Breach of Contract).

May laban po ba?

Depende rin dyan kung pwede kang ihabla for breach of contract, etc.

Ang nakalagay sa Resignation Letter ko sir is for Personal Growth and may ibang offer po ako sa company na mas magandang compensation na bibigay sakin.

So hindi mo pwedeng isumbat ang Art 285 dahil ikaw mismo ay nagsabing "for personal growth"

hindi pwede yung security guard for moral damages. pa explain mo sa arbiter kung pano yung ni aaply. medyo mahaba kasi.
i think they can win sa breach of contract against you but i still maintain na hindi dapt ni forfeit yung 13th month
