I would like to seek your insights and counsel please.
I was working at KybotechPh Ltd. for 2 years (August 28, 2014 to October 12, 2016) until I resigned. I am an Operations Manager there from August 28 to September 12, 2016. and was a Logistics Manager from September 12 to October 12, 2016.
I resigned because of the characteristics of my boss (MEAN and BULLY). Hindi ko na sya kayang pakitunguhan at yes, naghanap nako ng ibang trabaho bago pa ako nagresign.
At first ayaw nila tanggapin resignation ko but i was so adamant to leave. They told me I need to render 30 days but I said I couldnt as I have a new job (di pa naman ako nagstart agad sa new job) and I dont want to anymore. (Sobra na kasi sya manglait at mamahiya, I have screenshots of our conversations na pwede kong gawing ebidensya). Sabi ko I can do 15 days only.
After marinig ng Ex-Boss ko yung mga sinabi ko na ayaw ko magrender ng 30 days, he said he wont pay my 13th month and backwages. ALSO, he called our Company Security Guard to escort me out kahit wala naman po akong ginagawang eskandalo. Sobrang napahiya po kasi sya kasi sabi ko he is so mean and I coudnt stand him anymore.
My questions sirs and mams:
1. Ayaw po ako bayaran ng boss ko sa full 10 working months as 13th month pay ko. Ang pinapalabas nila now is babayaran nila ang 13th month ko BUT for the new Contract ko po as Logistics Manager which is just 1 month (September 12 to October 12, 2016)
May laban po ba ako if ipapa position paper ko na ho? Nag 1st hearing na kami sa NLRC and matigas po sila na ayaw ako bayaran..
