After release of Pag ibig loan / check, seller will not vacate the place

Hi Guys,

Is it possible to file a case against the seller if na release na ag cheke pra sa payment ng property nya and the seller refuses to accept the check and will not move out of the sold house? Or what if the seller will not accept the check and leave the country, what can I do about it? Thanks!

Bring it up with the Barangay Captain. He has jurisdiction to get assistance from Police if necesary.

Do you have clear sell documents signed by the seller?
If so, the Barangay Captain is suppoused to solve it rather fast.

Thanks for the reply. We have a deed of sale and the title has already been transferred to our name through Pag ibig.

Then it's suppoused to be a SIMPLE case for the Barangay Captain. Some Barangay Captains are bad though, but some are good.

(Or does the by both of you SIGNED Sale CONTRACT give the seller any chance?)
