Magandang araw po. Ako po ay dating kumuha ng pag-ibig housing loan for 25 years, nakapaghulog na po ako ng mahigit 7 taon, subalit dahil sa isang kadahilanan, hindi ko na po kayang maghulog at naisipan kong ibenta na lang ang house & lot dahil hindi naman ako doon nakatira. Nagkaroon po ako ng buyer at ito po ang naging kasunduan namin:

• Na ang pinagbentahan na si ______ ay babayaran ang halagang P 120,000.00 na hindi lalagpas sa isang taon simula Setyembre 1, 2016.

• Na simula sa buwan ng Setyembre 2016 ay siya na ang magpapatuloy sa pag hulog ng monthly amortization sa PAG-IBIG HOUSING LOAN.

• Na ang naturang paglipat ng pangalan ng bahay ay mangyayari lamang kung makapagbigay na ng atleast 50% sa nasabing halaga.



Siya naman po ay nagbabayad ng buwanang hulog sa pag-ibig hanggang ngayon. Subalit wala pa po syang naibayad kahit partial sa halagang P 120,000.00 at mukha rin pong wala syang planong magbayad.

1.Nais ko lang pong itanong na kung halimbawang hindi po sya makapagbayad sa itinakdang petsa at makahanap ako ng ibang buyer, magkano po ang dapat kong ibalik sa mga nahulog nya sa pag ibig?

2. Maaari po bang mailipat ang pangalan sa pag ibig gayong hindi naman fully paid pa?

1. What is stated in the contract? Is there a provision stated there for damages? To rescind the contract, you have to return whatever benefit you received (in this case, in the form of the payments to PAG-IBIG) minus whatever damages you might have incurred because of the delay and breach of the buyer.

2. I don't think the PAG-IBIG will allow that. Also, before you assigned your right over the property, you should have first asked the consent of PAG-IBIG. Technically, the payments were being made under your name.
