Hi Sir / Ma´am,

May tanong po ako. Kami po ng GF ko ay nagtatrabaho sa isang call center. and GF ko po ay may medical condition na nag cacause ng muffled na pananalita pero still understandable. magkateam po kami last month pero since nag perform sya ng maganda nalipat sya ng team. one day nag side barge ang TL nya sakanya at napansin ang pagiging muffled ng boses nya at minadali syang sinamahan sa clinic para masent home para mag collect ng med cert na ¨not fit to work¨ para mailipat sya ng non-voice account dahil concern daw sya sa kalagayan ng GF ko. Pero halata naman na parang nag dadamage control lang sya dahil iniisip nya na driver ng dissat ang boses ni GF. dahil sa pagkabigla napaOO nalang si GF dahil napaka sudden ng pangyayari. the following saturday nad consult na si GF sa DR nya at binigyan sya ng FIT TO WORK na med cert. the same night sinend ni GF ung med cert sa TL nya and until now naka LOA parin sya. I just want to make this clear, hindi sagabal ang boses ni GF sa pag cacalls dahil ang mga QA scores nya is pasado. is there any legal action we can take? yung forced LOA ni GF wala kasulatan na pinirmahan as to why she is being forced to take a LOA.

Follow the rules and regulations contained in your employee's handbook regarding escalation of concerns with your supervisor. Someone from the HR should assist you in clearing up this situation since the quality scores of your GF and her succeeding medical exam from a licensed doctor clearly shows that her voice does not affect the quality of her work in your department. They need to override the forced LOA that your supervisor imposed on your GF so that she can return to work, since his concerns are unwarranted as evidenced by the results of her medical exam.

Legal action is the last resort. Pwede pa mabigyan ng solution yung problem nyo using procedures inside the company. There are still managers and administrators who are higher in rank than your supervisor that can override his forced LOA or at least explain things with your supervisor and correct his action accordingly.
