OVER DUE PAYMENT VS.HARRASSMENT

Nakiride po ako sa Credit card ng friend ko amounting 20K,12 months to pay po from march 2010, and sad to say di po ako nakabayad on time kasi nawalan ako ng work,and now may work na ako i'm doing my obligation to her credit card, she demanded me to sign a promisorynote stating that I have to pay all of the said amount on or before january 30,2011. unfortunately I paid 8,000 pesos as of today, I don't have enough funds to pay all of the 20k today, but I can pay it on February, she is harassing me with her father and relatives, and her lawyer..what should I do? please help po.

did she pay her credit card even if you didn't pay?

are they asking for more than the amount of the debt?

what has her lawyer done? how the are harassing you?

I'm the one paying it po,...and they ask me to signed a promisory note. to pay it on jan.30,2011 but I dont have enough funds to do that po. she keep on calling texting na bahala na daw father and brothers nya sakin and the lawyer...

why not change your number so they can't harass you. then just pay this february, but ask for a receipt and quitclaim.

she already contacted my manager, and they will be here in the office by monday with the police escort, she tell alot about my debt to our manager.

my work is affected now, what must I do? what legal steps I have to do about it, if my manager do steps against me what next?

your manager should not do anything. this is not a work related matter.

threaten them that you will file criminal charges of unjust vexation against them if they go to your place of work.

failure to pay a debt is not a crime. they do not have the right to treat you this way.

Thank you po, for the advice, just incase where can i find a lawyer po? and besides all of them in the office knews about it, and they knew also that I my job is my only bread and butter. I'm quiet despair now.

you will have to look around for a lawyer. you can send them a message that says: i acknowledge that I owe you, but your threats of embarrassing me at my workplace is slanderous and unjust vexation. if you continue with your acts, I will be compelled to take legal action against you. I have committed to pay you within February. If this is not enough for you, then your threats are not proper.

i bet the police escort is BS. but if one does accompany them, take his name his assignment. have a friend take a video if they arrive.

what if my managers colaborate with them instead of discussing it with me she discussed it to others, as if they are concerns.

what action do I have to do with my manager who unjustly disscussing the issue with other people.and colaborating with the one who harass me

Hello Atty, your reply helps a strange guy like me. I almost had the same case, but not in terms of credit cards. I am Based outside of Philippines but have a big problem concerning my family back there, specially my dad. Someone keeps on calling him, threatens him and says bad words against just because of the delay of the processing of some documents which he asked me to do. As of this moment documents has done and tried to talk to him in several occasions but refused to listen to me. He already made a big damage by telling others that we are such (referring to negative words like manloloko and baliw. Would you mind helping me out what to do on this case? Tried calling our Consul here but failed to get as appointment for a reason which i don't understand. Your advice is highly appreciated. Thanks a lot

why is your dad being called? why does he not just change contact details? or he can file a case of unjust vexation or slander.
