Hi,

Ask ko lang po kung legal ang paglalagay sa amin ng company namin sa Temporary Dismissal(TD) for 2 months without salary, ang rason daw po ay dahil 90 days na daw po kaming walang project kaya binigyan kami ng TD. Ngunit yung rule na 90 Days ay hindi po nakalagay sa kontrata na pinirmahan namin, eto daw a alin sunod sa rules ng mother company na nasa India. Nais ko po malaman kung anong kaso ang pwede naming isampa sa aming company.

How long have you been employed Sir?

This temporary dismissal of yours is akin to a "floating status" wherein you are placed on a supposed leave since no projects are currently available. This floating status however is valid only up to 180 days or 6 months. Beyond this, there is already constructive dismissal on the part of your employer.

I've working here for 5 yrs. na, nawalan ako ng project Feb. 2016, last July 2016 they have put me in TD with the reason lack of market for 3 to 6 months, then gumawa ako ng paraan para magka project ako, tinawagan ko yung dati kung client asking for project and she gave me, at pinabalik ako sa office and the project started August and ended September,now recently some of my co-employee has been put to TD, I just want to know if this is still legal considering thier reason of 90 days no project?

Kung walang trabaho para sa inyo pwedeng i-float kayo.

Hindi rin naman pwedeng tuloy-tuloy kayo mabayaran kahit walang ginagawa o kinikita ang kumpanya.

So ibig sabihin wala kaming laban d2 kahit na nakikita namin na tuloy tuloy parin sila mag hire ng mga tao? at hahayaan na lang namin magutom pamilya namin kc hindi kami pwede maghanap ng trabaho kc technically connected pa rin kami sa company.

bawal daw yun sabi ng company namin, kung gusto to daw namin maghanap ng bagong trabaho dapat daw ay magresign na lang daw kami sa company, which is yun ang gusto nila para hindi sila makapagbayad ng separation pay in case na wala na kaming babalikang project pa.

Hindi pinagbabawal ng batas na maghanap kayo ng trabaho habang konektado pa kayo sa kasalukuyang kumpanya.

Hindi naman praktikal mag-resign habang wala pang lilipatan lalo na kung wala naman silang binibigay ng gawain at hindi kayo nababayaran sa mga araw na walang gawa,

pwede kayong maghanap at tumanggap ng trabaho sa iba. Ang employer ay meron 180 days to hire you back. If during sa 180 days na ito ay bigyan kayo ng return to work order or new job offer from the 1st employer, may option ka kung gusto mong bumalik or manatili dun sa bago mong employer. If hindi ka nila mabigyan ng job offer within 180 days, kelangan ka nilang bigyan ng separation pay kahit na meron ka nang ibang trabaho.

Wag kang mag reresign unless meron ka ng bagong trabaho at wala ka ng balak bumalik sa luma mong employer. Tandaan lang if ang plano mo ay kukuha ng temporary job at babalik sa original employer na wag pipirma sa contract na mahaba ang duration kasi baka di ka na makabalik sa original employer pag ikaw ay pinatawag

Salamat sa lahat ng nag post ng kanilang comment, I guess wala talaga kaming laban sa company namin, lagi na lang nila ito gagawin everytime na may mawawalan ng project. Bad for us employees kasi na may mga pamilya gutom ang aabutin namin, gustohin man namin mag resign kaso na pipigilan kami dahil back pay lang makukuha namin kahit na 7 years kapa katagal sa company. If we can only have our ways we will DISCOURAGE ASPIRING I.T. PEOPLE NOT TO BE LURE WITH THE BIG SALARY THEY ARE GIVING, BECAUSE IN THE END ONCE THERE IS NO PROJECT FOR YOU, YOU WILL BE PUT ON FLOATING STATUS WITHOUT PAY, IN THIS IS VERY POSSIBLE TO HAPPEN BECAUSE THEY ARE NOT GETTING SMALL CLIENT WHICH IS NOT A FORTUNE 500 COMPANIES, BECAUSE THEY WANT TO BE LISTED IN STOCK MARKET AND THEY WANT THE BUSINESS WORLD TO KNOW THAT THEY ONLY CARRIES BIG COMPANIES, WHICH WE THINK IS VERY BAD TO THE COMPANY.

If you feel na unscrupulous ang employer nyo and is just using this to get you to resign, you better look for another place of work, kasi pwedeng gawin nya, one month project then 6 months floating then one month project ulit and six months floating.

Actually if you don't have a project they will give YOU 90 days to look for a project. take note "YOU" hindi sila maghahanap ng project after the 90 days if you have no project they float you for 180 days, but before mag lapse yung 180 days they will call you back a present a project that it's not fit with your skills and if you did not accept the project then they will ask you to explain why, after explaining to them that you are not fit with the project they will tag you as red flag to them and will be put again to floating status for 180 days. ANG LUPET DIBA???
