Arresto Menor

So I bought a Smart TV in 2014 primarily because of the Netflix capability, however, back then such a service was not available here in the Philippines - however I was already anticipating the service to arrive which is why I considered buying the product in the first place.

When netflix arrived in the philippines, the TV was unable to connect to service (still is), I have recently confirmed with the TV's Support desk that the TV I bought is not eligible for a firmware upgrade and the current configuration cannot be changed.

With those details in mind, is it possible for me to claim a return or refund of the device under the Consumer Act of the Philippines?
