Hi! I handed my resignation letter last week and according to the HR, I won't be receiving my salary during the turn over period of 30 days. Yung 13th month, coop contributions and salary for the remaining period will be given two months after the resignation date or later.

My question po:
1. Tama po ba na gawin un ng employer?
2. Will there be charges filed against me if I will start reporting to my new employer na? Baka daw po kasi di kami bigyan ng COE. At the same time, sayang naman po kasi yung 30 days na di naman po ako sasahod sa current employer ko.
3. Reasonable period po ba yung pag withheld nila ng back pay?

1. Pwede, kung yun ang nasa patakaran. Generally ang huling sweldo at ibang matatanggap ay naka hold.

2. You can report to your new employer - after your last day of work (in 30 days).

1. Tama na i-hold kasi magiging part na yun ng Back Pay mo.

NOTE: Bayad ka sa mga araw na papasukan mo during the turn over period pero matatanggap mo yun as back pay.

2. Basta walang damages na mararanasan ang kumpanya mo sa hindi mo pag-turn over e wlang kasong maifa-file laban sayo.

NOTE: AWOL o hindi, Terminated o resigned, walang koneksyon sa COE yun. Lahat ng empleyado ay dapat bigyan ng COE basta cleared na sa lahat ng accountabilities ang empleyado.

3. OO, kaya hini-hold ng kumpanya yun ay para kung my nakita silang accountabilities mo ay pwede nila kuhanin o singilin sa hino-hold nilang sweldo mo at legal yun.

Follow up question lang po.
Before our last day po kasi, we can already accomplish our clearance. Wala rin po kasi sa contract and any handbook ng HR namin yung withholding period.
I also asked my friend from BIR po kasi. Sabi po nya, ideally, sa last day ng isang employee, mairelease na dapat sa kanya yung 13th month pay nya, 2316, and others. At the same time 3 payroll cut-off pa before my last day.
Given I accomplished my clearance on my last day, can I demand na po ba? Can you also enlighten me dun sa sinabi ng friend ko from BIR?

Like what you said, 'IDEALLY' not 'MANDATORY'. Since it is not mandatory to release final pays on the last day of employee, it is then NOT demandable.
