Hi,

Gusto ko lang po malaman if legal or unfair labor practice yung ginagawa ng company namin.

Employees are entitled to 15 days Vacation Leave and 15 days Sick Leave..We are paid naman for taking leaves, but we are required to make up for them (By working extra hours or doing Overtime)..so parang walang leaves din..Same goes for holidays, we are paid, but we need to make up for them.

Tama po ba ito? Can this be a basis to file for a complaint sa DOLE?

There are industries that can require OT. this is supported under the Labor Code.

If the need arise, any company may require its employees to render overtime. As long as you are paid for it, there's no problem.

we are not paid for it, kasi they treat it as make-up hours for our leaves

this is not the issue po.we all know this..

ang issue po is that pwede kami mag leave pero kelangan din namin bawiin by working extra hours

5 days a year lang ang mandatory incentive leaves. I think you the company is giving you non paid leaves which is legal but hindi dapat mawala yung 5 paid leaves. If this is unused this accumulates and can be converted to cash when you retire or resign

pwede ba kayong i-require na i-make up yung leave ninyo by working extra hours or forced OT?

PWEDE. kasi depende sa need ng employer. baka based sa billable hours sa client. so every person has their respective # of hours to comply. so doon papasok yung may mga industries na pwede magpa-require ng OT dahil nabawasan ng working hours si employee dahil nag-leave. hindi naman sa wala kang leave, pwede ka naman mag-apply ng leave. yun lang aftr that you have to make up for the hours. totoo na mahirap nga iyan but to question the office policy na nire-require ng amo na bawiin mo yung 8 hours work mo per day by distributing it to the rest of the week... hmmm i mean not sure kung bawal yuyun kasi parang wala restrictions doon.

you have to be paid for the extra work. A fair day's wage for a fair day's work or something like that principle. pwede ka na magreklamo ng nonpayment of wages kung hindi ka sinasahuran maski nago-ot ka. yun na ang bawal.

hindi sya sinahuran kasi binayaran yung "leave" nya. technically it wasn't a paid leave

Hi ang pag kakaalam ko po pag nag leave ka your paid for that, pero you don't have to offset whatever ung number of days na nawala ka.

Unless it's OT which goes with extra fee then ibang case po un.

If mag rerequire po sila na ioffset ung time na wala ka dapat po hinde bawas ang leave credits nyo

base lang po sa experience ito
