Good day Sir..ask ko lng po kc asawa ko is seaman.hiniwalayan po niya ako last may 2013 but not legally. we have 3 kids.since naghiwalay kami he is supporting us not more 20 thousand per month at 15 kung nakababa siya.i always asked him to increase my kids allotment kasi tatlo sila and i dont have a job po kasi nung kami pa eh ayaw nya akong mag work because he wanted me to focus on our children.everytime i told him na magpadagdag ako ng allotment kasi kulang talaga wla siyang action.if i told him na pupunta ako sa opisina or poea tatakutin nya ako na kung hindi sya mkakasakay nganga kami ng mga anak nya. ive read po online na the childs support depends on the fathers income. magkano po ba talaga matatanggap namin na allotment ng mga anak ko mula sa kanya?what will i do po pra e obliged sya na magbigay whats financially right for my children?hoping for your answers po...maraming salamat;;

support is based upon the income of the father.

Totoo yung sinabi niya na kung kakasuhan mo siya hindi siya makakaalis.

You have to prove that your husband is earning so much and is providing only so little.

THe law does not say the exact percentage but only states what is covered under support.

There is no exact amount nor percentage. If you will say 50% that is regarding mana and your husband needs to pass away first. Also, if you both legally seaprate and/or anull the marraige then pwede din distribution of remaining properties.

All that being said. If the support provided is not enough. Mag-work ka na and raise enough money to bring him to court so that you will not be dependent with the support you need from him.

Your intention to raise your kids personally is commendable but times are trying and even the mother needs to work.

You can still bring the father to court but be ready to suddenly suffer a cut from support. This is the reasonw hy I want you to look for work first. This will balance the scales.

im planning to work pro wlang magbabantay sa anak ko.my mother is old enuf n cancer operated.d ko nman pwedeng iasa mga bta sa kanila.and i still have a 2 years old daughter.i just want to meet in the middle.gusto ko sana na pirmahan kmi sa isang lawyer regarding sa support nya sa mga bta..if ever il file a case against him what would it be?

Can I ask LNG po.aren't we entitled to get the 80% of his earnings wherein fact I'm his legal wife?He is an officer in a ship he is working so reality check he is earning much.I'm not against him having another gf because I cannot force him to go back to me when he doesn't want to.I just want him to support his 3 children.can't my children have the right for financial support from their father?can't the law tells us how many percent can children gets from their father's income?

Him being a seaman adds risk he can't be forced to pay.

Does the ship belong to a PHILIPPINE company or foreign?

If foreign, the Philippines don't have jurisdiction over his salary, so can't force him, except he risk jail IF he enter the Philippines.
So if you go to court it's risk he just don't bother what the Philippine court say.
Some countries cooperate though,
and it's possible a foreign company cooperate, because they want good contact with the Philippines.
