Hello, Please help po..pwede po ba madeclare na missing ang isang tao kung hindi na kayo nagkikita ng 17 years?...I want my mother to get married again because she deserved to be happy but she was scared to married because maybe my father still alive. Then we requested an info from NSO to look if my father married another woman, then it shows YES...so meaning buhay pa siya..many people says she can remarried again already, but we want it in all legal process. Some says she can get annulment and never bother my father about it but needs to have P300,000 payment for process. Some says, report my father as a missing person then my mother can married again. Please Help, I am currently in New York and I want to petition my mother and stepfather for the future. Definitely I am needed a straight advice here, thanks in advance.

Ann, that is so sweet of you to want this for your mother.

The first option is to have your father declared presumptively dead. To have this prosper, all efforts must be taken to determine whether he is alive. your mother will have to try to contact his relatives, friends, etc and prove this in court. she has to show that there is a good faith basis to believe that your father is probably dead.

on the other hand, for annulment to prosper, there has to be a valid ground which can be proven. I presume there have been persons who offer you 'package deals' with 'no appearance'. I do not engage in such practices, but I acknowledge they exist.

I have encountered one instance where someone went to the US and acquired a divorce then married her fiance. It will be valid there, but not here. she had to be careful coming back here because of the risk of being charged with bigamy, but was perfectly safe in the US
