hi good day po. nag-attempt po ako gumawa ng against sa company policies. hanggang attempt lang po. wala po akong ginawa. ang kaso po nagsumbong ang contractor at ipinakita ang ebidensya nang pakikipagdeal ko sa kanila. dismissal na po ang action dun. thank you

Nag-attempt ka gumawa ng bawal.
Pero merong ebidensya.
So meron ngang bawal na ginawa.

matatanggal pa rin po ba ako? kasi nakikipagdeal ako kay contractor? pero wala pong natapos at malinaw n deal at wala po akong nasimulan sa gagawin ko sana para sa kanila.

Minsan ang "balak" ay may kaparusahan din.

Merong mga batas na nagpaparusa ng mga "attempted" na krimen.

Pwede ka nilang tanggalin kung meron silang pagdududa sa iyo dahil sa nalalaman mo na pwede mong ibenta o ibigay sa kakumpetensya.

100% sure po ako wala akong ginawa para kay comtractor. pero nag-attempt na gawan sila ng accomplishment report(dapat sila ang gagawa) para may maipasa sa kampanya kasi nanghingi sila ng tulong dahil di sila makagawa.january reports nila.

nagkausap sa text may 14 po,then next usap june 2. tapos walang malinaw na deal. tapos june 21 dumating ang isang tao ni contractor nagbigay ng pangmeryenda. tinanggap ko pera. july 9 nagtext ako para saan talaga yun, ang laki 5k, tapos sinabi nya na para dun sa reports. so sabi ko ibabalik ko ang pera kasi di ako nanghihingi. di naman talaga ako nanghihingi. after nila magbigay ng june 21 hanggang ngayon or kahit bago magkamemo ako, july 14, wala kaming communication ni contractor. wala silang hinihinging update or nagfollow up wala.

at 100% sure po ako wala akong ginawang report para sa kanila. at di ko rin sila tinggalan ng liquidated damages.

Lost of trust and confidence - that is enough to terminate you legally.. the management has all the right to do this to you after your undesirable attempt against the company.

Lost of Trust and Confidence cannot be applied to all kinds of infraction. Do look at the position of the employee who committed the infraction. There must be an intimate relation between the position of the employee and the infraction committed. Also, do look at the factors and circumstances of the case.

i agree @hrdude.. but since the the details of the  "attempt" to deal with the contractor were not provided, my initial verdict would be Lost of trust and confidence.. of course due process must be practiced.

The Management of course has the final say, to terminate the employee or impose lower penalty.

Terminated or not, all separated employees have the right for a Certificate of Employment as long as they are cleared from all accountabilities.
