ganito problema namin, may kumare kami na nangutang samin ng 50k, tumagal na yung utang hanggang need na rin namin talaga yung pera pang tuition sa school ng mga bata. so we agreed and the school also agreed na babayaran ng kumare namin yung tuition with a post dated check, so dumating yun date of clearing walang pondo yung account, then tumawag school samin, advising us of the problem, so kinausap namin yung kumare namin and sabi nya sya na bahala dun pupunta sya school para ayusin problema, tumakbo ang mga araw wala na kami natanggap na complaint mula sa school so kampante kami na okay na, yun pala nakiusap lang yung kumare namin na wag ipasok sa bangko yung cheke, at babayaran na lang nya. pumayag ang school and nung 3rd grading ayaw na pa-examin mga anak namin, dahil di pa daw bayad sa tuition. kaso yung checke na inissue ng kumare namin e expired na, lagpas na ng 6months. we are forced to pay the tuition, and wala din kami magawa sa check dahil sa school naka-issue, pwede po ba kasuhan pa rin yung kumare namin? pasok pa rin ba ito bouncing check law?

if you file a case of bp 22, it will have great difficulty prospering because it is the school which should be the proper complaining party. unless of course, the school is willing to be involved in litigation.

what you can do is file a civil case for collection under the small claims rule. references on sc.judiciary.gov.ph
