Yung company na kung saan ako na assign ng agency, hindi nagbigay ng salary increase.

S.O.P. naman na pag nakaone year kana sa company na assigned sa iyo dapat may increase.

Attorney, kung mag push ang case saan ba bagsak nito NLRC ba o pwede na straight mag file ang software house sa court.

Good evening atty,

Im a cashier of a private school. Nagsign po ako ng kontrata ng 1 year contract plus 4 years commitment contract. dun po s 4 years commitment contract pag di daw po kami pinayagan magresign kelangan naming magbayad ng 45, 000 pesos per year of contract na di namin natapos. bale xe po nung isang araw tumulong ako sa kahera sa college pero 5 transactions lang naman ginawa ko. pero ang mali kasi ko po kasi isinama ko un sa kaha ng kasama ko. bale sabe po nung accountant sa school paghatian namin ung short tapos ikaltas sa sahod namin. wla naman po akong kinuha at ginawa ko naman pong maayos ung trabaho ko. ayaw ko pong magbayad kasi malaki pong pera ung short. atty ano pong dapat kong gawin? binabalak ko na din pong magresign sa trabaho once na kinaltasan nila ako. pero ang inaalala ko po ung pinirmahan ko din na kontrata na 4 years.kelangan po ba akong magbayad ng 45, 000 ng apat na taon?

hello i hope you can answer as this is very urgent.i know this letter will take so much of your time.pls bear with me. I applied for a part time art teacher as stated on thier job posting.then i got hired.before signing my contract they gave me two options para sa workscope ko.1st otion po is full time 8 hour po na art teacher /secretariat and office job na involve and coordinate sa mga schools with basic pay naman po ito.

2nd option po is art teacher and coordinate lng sa school and ung salary po dito is after kong makapag turo.meaning every time na may turo ako at maka quota dun po ako masweldohan.
being a mom pinili ko po ang 2nd otion para maluwag po sa schedule ko at since wala naman po akong experience sa office at secretarial job.nung nakita ko na po ung contract ko.nakalagay po dun ung work scope ko na may marketing,basic office and secretarial job na po na kasama plus deliverables and errands.
since need ko din mag ka work pupirma po ako ng contract na di ko na po gano napag isipan, which alam ko po on my part ay mali po ako dahil sa exitement ko makapag work at sa mga magagandang scenario na sinabi nila sakin at sa dahilan kelangan ko din tulungan ang asawa ko dahil sya ay freelance artist lng din.

Kung kakasuhan po ba ako ng employer ko,
Wala po kaming contract, pero almost three years na ako dun,

Nakamaternity leave po ako ngayon, June23- Aug22.
July 22 po , nagfile ako ng resignation para saktong pagkatapos ng M.Leave ko, hindi na ako papasok ... dahil 30days notice po di ba?

Kaya lang po,
Hinold po ako ng Division Head namen dahil HINDI DAW PO PWEDE YUNG GAGAWIN KO.
Hindi daw po ako pwedeng magresign ng ganun.
Nasa rules daw po yun ng DOLE.
KAILANGAN DAW PO MAGREPORT MUNA SA DUTY AT MAGBALIK TRABAHO BAGO MAGRESIGN.

Totoo po ba yun?

Kasi po maa-AWOL daw po ako,
at since sa ospital ako nagtatrabaho, at dun po ako nanganak ng libre (benefits),
Parang sinasabi po nila na kailangan ko daw bayaran yung nilibre saken kung hindi na daw po ako papasok right after..

In short po,
Kailangan ko daw po pumasok pa...
Ang problema po, wala po kasing mag aalaga sa anak ko, kaya hindi na rin po ako pwedeng pumasok.

Ang tanong ko po,
Kung ma-AWOL po ako, may habol po ba sila saken sa sinasabi nilang babayaran ko na ginastos nila saken sa panganganak ko?
Pwede po ba nila akong idemanda kahit wala akong kontrata sa kanila?

Plano ko po sanang HUWAG NG PUMASOK... Dahil ayaw ko na rin po.

Sir my bago po akong problem tungkol pa rin sa cash bond. pagbabayarin po ba ako ng 45, 000 xe po nagdecide na po ang pamilya ko na lumipat kmi sa bataan. tga pangasinan po ako. magreresign na po ako this september so hindi ko po matatapos ung kontrata.

Hi AttyLLL,
Here is my concern, I have signed a contract in one multinational agency to be deployed in a company in SG. 1 week before my start date, the company where I will be deployed suddenly perform cost cutting, thus my contract did not push through in the said date. My resignation on my previous company has ended before my supposedly first day in SG. So I asked for damage, is is pending approval on the HR, but after 5 days, the agency called me again, saying that they did do a solution so I can start in that company ASAP (similar Job post, and salary), I have some colleagues there, saying its still cost cutting so I dont want to continue there, instead I'm just applying here in the phils, but as per the agency, the approval of the damage might get rejected since they manage to get a solution, but on different date.
I want to get my damage, but will not continue my contract with them since I do not trust them anymore, im jobless because of their contract. Please advice if I still can get the damage fee.

Hello Sir/Ma'am,

Our signed contract five years ago in our company indicates our payout schedules are every 15th and last day of the month. But now, they are moving the payout dates to every 1st and 16th of the month for the reason of ensuring accurateness and timeliness of the payroll process to establish consistency and efficiency. Is this a possible breach of contract? Also, if they would let us sign a new contract just to indicate the new payout dates, can we reject signing to it since we don't want to agree with their new policy? Thanks.

Hi I'm working in Lending company for 2 years and i'm a regular employee; but last week our management decided to change or revise our contract. in this contract my expiration or duration na po ang aming contract for 6 months at renewable naman daw po ito... Legal po ba ito?

No, I don't think so.

If they want to change it, they should first effect your separation, then re-hire you under a new contract if at all possible or if you are interested.

Ang 1 day ngayon, pwedeng maging 2 days next time.. Yung point ko is yung nakalagay sa contract na in-agree ng both sides. Ngayon gusto nilang baguhin without us agreeing. Ano pang gamit ng contract kung di rin naman susundin..

Do not interpret contracts too literally that it becomes one-sided.

The situation above of changing the payday does not affect anyone negatively nor does it give the employer any unjust advantage.

In a way similar to your contention, if your contract does not specifically say when you are supposed to have your lunch break or when you can go to the toilet, then the company is within its rights not to have you go to the toilet while working.

Hello po Atty.. may tanong po ako about breach of contract po, sana po ay matulongan nyo po ako..

I signed a 3 years contract in a private school po last year April 2015, nagbigay po ako ng resignation letter po May 2016, after ko nagbigay ng letter po eh wala po akong natanggap na any formal letter galing sa principal po namin regarding my resignation letter. Nag inform lang po sya saakin through chat na kelangan magbayad po ako sa kanila ng 20,000 bond po para sa damages po para sa remaining 2 years po at nagbabala po sya na kelangan maibigay na yung pero with in a month po, kung hindi po ay magrereklamo po daw siya sa labor. Through chat lang po yung, wala po akong natanggap na any formal letter po. Atsaka po yung contract po namin ay walang nakasaad doon about bond po..

Questions:
1. Dapat po ba na may formal letter akong matatanggap after giving my resignation letter containing what the company wants me to do like dapat po akong mababayad ng bond or something po at hindi po lang through chat ako i.inform ng principal?
2. Is it reasonable po na singilan ako ng bond po na wala po sa contrata na pinirmahan ko about bond po?

1. If they intend to collect damages from you for breach of contract, they will send you a demand letter at one time or another.
2. Technically if wala sa contract hindi sila dapat maningil ng bond sayo but they can ask for damages so parang pareho lang. If a settlement cannot be reached, the court will decide if yung P20,000 is reasonable or needs to be smaller. (this is assuming P20,000 lang ang hingiin nila sa court)

I do not think sa labor sila mag file, sa court i think dapat. I don't know if it is reasonable but if makatanggap ka ng notice na dinedemanda ka, then parang demand letter narin yun
