Does an employee who rendered 10 yrs and above & voluntarily resigned from a company can get a separation pay from his employer ?

Only if there is such a benefit (ie retirement benefit) in the company policy that provides for it.

Hi po. I just want to gain legal insight regarding my situation.
I resigned from my work last May 2 2016. My immediate superior allowed not to serve the mandated 30-day notice.
She told me that pwede naman daw yun kaso hinde ko daw makuha yung unused leaves ko, in a tone na parang concern siya sa akin regarding that matter.
Bale ang makuha ko lang is yung pro rated na 13th month and tax refund kung meron.
I asked our HR manager if this is true, or baka yun lang ang pagkakaalam ng immediate superior ko regarding immediate resignation.
Ang sabi ni HR hinde naman daw ganun. Makukuha ko naman daw unused leaves ko.
I haven't received my last pay, I just want to know if it is legally right na hinde ko nga makuha yung unused leaves ko, para at least alam ko kung mag reklamo ako o hinde sakali makuha ko na last pay ko.
And with regards po dun sa tax refund paano po ba compute yun?
ang pagkakaalam ko po kasi may refund ako kasi May ako nag resign, and this is equal dun sa tax na nakuha sa akin from Jan to May. Tama po ba yung alam ko?
I just want to be guided accordingly.

Depending on company policy, leaves may not be convertible, more so if you have already used up some of them.

Tax refund depends mainly on your income and tax withheld. It's possible to get most of the tax back, or even just some. But definitely not the whole amount.

naitanong kasi ng isang co employee ko sa DOLE na pag ang isang empledao na nag resign at nkapag work below 5 years sa isang company , wla syang separation pay na matatanggap except yung 13th month pay , tax ( kung meron man ) at yung nai pondo nyang araw na naitrabaho nya o na irender nya . Pero pag ang isang empleyado na nag resign sa isang company na nag serbisyo ng 5 years & above , may makukuha daw sa separation pay na 1month salary for every year year of service plus yun 13th month nya for the current year . Yan po ang batas na nasa DOLE ayon sa empledo ng DOLE na nakausap ng kasamahan ko at kailangan tuparin ng company , hindi lang yung 13th month at render days ang babayaran ng kumpanya . Ano po ang opinion nyo tungkol dito ?

Wala yatang ganun, pwera na lang kung nasa kontrata, kasunduan o CBA.

Hindi po tutuo yan. Eto po yung hotline ng DOLE NCR 400-62-42 or 400-39-18. If hindi kayo sa metro manila, let me know i will try to find the right number for you to call. Pwede po kayo magconfirm dito. Wala pong separation pay sa mga nag resign ExCEPT if merong nakasulat sa contract or sa CBA or company policy.
