Hello,

I'm new to this and this might be simple questions. Our company here in the Philippines is indefinitely closing due to serious financial loses, I just want to confirm is separation pay is a must for redundancy? Is there a law that prevent the a company from giving a separation pay?

Clarify lang natin ha.

1. redundancy - eto ay kapag tinanggal ang empleyado dahil gusto ng companya na makatipid or dahil hindi na kelangan ng empleyado sa position. Example: driver, binenta na ng companya yung sasakyan kaya wala ng mamanehohin yung driver. Kumikita parin ang company
- you get 1 month for every year of service.

2. retrenchment - eto ay magbabawas ng empleyado ang companya para hindi malugi. example dati apat ang janitor, gagawing dalawa nalang. nalulugi ang companya or malulugi na ang company (kelangan patunayan ito ng company)
- you get 1/2 month for every year of service

3. business closure due to financial losses - magsasara dahil sa pagkalugi
- no separation pay

4. business closure due to non financial losses - magsasara dahil sa ibang rason. (ex. Gusto na mag retire ng may ari)


If ikaw ay sa #3, walang separation pay. 1,2,4 meron separation pay
-1/2 month for every year of service

Another question po, if they did business closure, can they cancel the termination anytime a potential client is won within the 30 days of informing us about the closure? Meaning pwede ulit nila sabhin na di magsasara yung company after declaring it as business closure within 30 days?

yes, they may cancel as long as hindi pa finalized.
