Hi, need your help regarding Holiday pay rules. I am currently working in a BPO company. Our rest day is every sat-sun, are we entitled for a Legal Holiday pay like the May 1, 2016. Sunday, Labor Day even if it falls on our rest day. As per DOLE, If the employee does not work during a regular holiday, the worker is still entitled to 100 percent of his salary for that day... But when we asked our HR and payroll, they said we are not because our salary is monthly basis not daily. Does it matter? There are times na wala kami pasok like pag holiday sa Australia kasi wala naman daw calls, pero hindi din kami paid not unless kung gusto ni employee ibabawas sa VL credits para paid ang araw na yun. Dapat kung monthly base kami, dapat bayad yun dahil hindi naman namin gusto na hindi pumasok, si employer ang may gusto na hindi kami ppasok.
We want to know kung tama ba kami and ano ang dapat namin gawin. Thank you for your time.

monthly paid kayo so automatic bayad kayo kahit di pumasok ng rest day. pag nagkataon na holiday ang rest day, walang dagdag na matatanggap.

Kung holiday sa Australia (Monday, April 25 - Anzac Day), sasabihin ni client na walang ops, so walang bayad sila sa BPO, so in theory pwedeng sabihin na mag VL kayo para mabayaran on that day.
