Constructive dismissal while still with the company

We have a case of constructive dismissal
demotion of rank and benefits
unbearable treatment with our employer
breach of trust and confidence (can be establish)

We file a case at NLRC and case is still ongoing
We are already on the position paper and on the position paper of the employer we are not constructively dismissed since we are still working with the company

Our reason will be because of medical benefits wherein one of my dependent(parents) is using my health card because of thyroid issues and according to the dr that it might be cancerous also I might undergo on treatment again of kidney stone I found it on my city ultrasound result.
