Hello... Sir /ma'am i need advice po..may nag bebenta po kasi sakin ng property house and lot po.. Then sa deed of Sale po nilagay ng buyer na lahat ng expenses like capital gains tax, documentary stamps tax , transfer tax,and filing fee po is need ko i shoulder tama po ba yon? And naka lagay din po sa contract na pag hindi daw po ako nakapag bayad ng 3 consecutive months e mawawalan na ng bisa ang contract amd lahat daw po ng naibayad ko na e hnd na maibabalik kahit magkano...at kusa ko daw pong ibalik ang bahay at lupa.... Tama po ba yung nakasaad sa contrata?

Hello po,

If you agree with the contract and you sign it, then it binds you to its conditions.

The conditions you are saying (no payment for three months will forfeit all payments made) is standard. Please remember though, that any contract protects most the one who prepared it.

Bali diba po dapat yung capital gains tax is shoulder ni seller...? Tama po ba?

Tapos po ako po ang bumibili ng lupa pero pinangalan nila sa parents ko at ni sign naman po ng parents ko.. Since wala po kasi ako dyan sa pinas kaya daw po dun nila pina sign.. Pero ang instruction ko po i eemail po sakin ang deed of sale para po ma sign ko.. Pano po dapat gawin since na sign na ng parents ko.. Possible pa po ba kaya na pagawan ko ng bago at pa shoulder ko po yung capital gains tax?

May Special Power of attorney po ba ang parents nyo? If not, they cannot sign the document for you - that would be fraudulent. And kapag ipapa-notaryo nyo ang DOAS, pwedeng kasuhan ang nag-notaryo.

Ang capital gains tax is usually shouldered by the seller, BUT will depend on what the buyer and seller have agreed to. Hindi po Ito automatic na sila mag-shoulder so please clarify with the seller.

Pahabol po... Pwde naman po yung sinabi ko po sa seller na i email sakin yung deed of sale tas i print ko po dito then scan ko at i email back ko po sa kanya dba po?
