Changing surname is a sensitive matter and has implications on identification and inheritance. For these reasons, it has to go through a court petition to secure an approval. Kailangan mo ng abogado to represent you in court, to gather and organize evidence favorable to your petition, schedule this in court, publish a notice etc. For quick reference, subukan mo munang magtanong sa Office of Civil Registry kung saan ka registrado for further inputs, possible referrals and validate my view.

Good Afternoon Atty.

My problem is double posting daw po ang birth cert ng anak ko sa NSO kaya block po yun 2nd..yung first file ng ex kbut hinde po nya anak  but acknowledge her and then after umalis na po and nowhere to be found and never din nagsustento dahil hinde naman po nya anak. Then bumalik po yung biological father and now my husband (filed late registration for her daughter under a new name but sane birthdate) but we cant get a copy from NSO dahil double posting na daw po ito.Ask ko lang po Atty ano dapat gawin kasi ito na po ang gamit na name ng anak ko from the very beginning nag start sya sa school now grade 6 na po sya ask na ng school ang NSO copy nya. Please enlighten me what is the best remedy.Thank You and God bless

you have to file a petition in court to nullify the first birth certificate. you will need proof that the biological father is the actual father.

Atty hinde pa po ba enough yung ina acknowledge nya po na anak namin..sya po nagsupport mula noon hanggang ngayon. Kasi kasal na po kami..ano po ba ang pinaka best solution para mas mabilis maayos ang bc ng anak namin? Magdudulot po kasi ng confusion sa bata if ever yung unang Bc ang gagamitin dahil iba po ang pangalan at apelyedo na nagamit dun.Salamat po Atty.

someone else acknowledged the child first, and did you not sign the birth certificate also allowing this? so as far as the law is concerned the the first birth certificate is the proper one. you can go to court as your remedy and prove that the 2nd father is the actual father, else NSO can do nothing

either way, you have to go to court. i would recommend getting a dna test and a petition to nullify or amend the first birth certificate. adoption is also possible but very cumbersome and you'll need the consent of the listed father.
