I signed a 2-year contract. After a year of service, the employer said that the contract has been waived due to the changes of the members of board of trustees. The faculty was told to undergo the reapplication process (teaching demo).

Question: Is it legal to waived the contract due to the changes of board of trustees?

Furthermore, the employer insist that the re-application process is a part of professional growth. But if failed in the evaluation, it will be grounds for termination..Do you think this is just and right?

The faculty demanded for penalty for breach of contract. The administrator claimed that no separation fee is ever written in the contract/agreement.

Question: Isn't it the faculty has a right to demand such charges even it is not written in the contract?

1. Change of composition of trustees is not a valid waiver. The school must respect and comply the contract in good faith.

The "reapplication" process during the existence of contract constitute as constructive dismissal, thus, not a valid right of yhe school.

Yes. the faculty has the right to demand separation pay aside from damages due to breach of contract commited by the school.
