Hello Atty., gusto ko lang din mag tanong may employee kasi kami she was employed last feb. then nabigyan namin sya ng contract last may na so instead na dadaan siya ng trainee or apprentice ginawa nalang namin syang probationary dahil din don sa matagal namin nabigyan ng contract now the problem is marami siya issue isa na doon is dishonesty, lagi siya late kaya lang hindi namin alam kung tama ba yong DTR na inilalagay niya considering na siya rin ang nagpaprocess ng mga time in and time out ng mga employees tapos marami din siyang absences though nag tetext naman sya kung aabsent siya kaya lang lately my pinagawa kasi kami sa kanya tapos bigla nlng ng text 30mins prior sa schedule nya na hindi siya makapag report and we already informed her na mag inform dapat ahead 3-2hrs kaya naiinis na ako kasi parang abuso na, at saka she cant follow simple instruction like may papagawa ka may ipapaprint. Ang tanong ko po Atty. pwede ba namin icancel yung contract niya na probationary the period of the contract is May 2011 - November 2011 hindi ba kami malagay sa alanganin considering na February pa siya na employed but yung contract nya is May na? Antayin ko po ang reply niyo maraming salamat.

a probationary employee has security of tenure for the period of probationary period. you can only terminate her for just or authorized cause during this period.

i recommend you sit her down and give her a memo that if she does not improve, it will be unlikely that she will be made regular.
