I worked in the Philippines from December 1970 to March 1981 for 3 reputable employers who are still operating up to now. There were practically no gaps between these employers. I provided copies of certification of employment from these 3 employers and the total period of employment is over 10 years.

I was advised by SSS that their records show that some monthly premiums were not paid as a result I would not be qualified to receive the pension.

SSS is suggesting I pay the premiums for the months where they are not showing in their records. This is despite the fact that the 3 employers are still operating in Makati City. Why is SSS not chasing them instead?

Questions are:
1) Whose obligation is it to ensure that the SSS premium is collected from employers?

2) Should I pay for the unremitted premiums or should SSS chase the employers?

3) What is the legal process to complain or appeal the SSS decision of not paying my pension because of these unremitted premiums?

I would appreciate any comments or legal advice.
