This situation just popped in my mind and I wasn't sure how to resolve it. Might make a good subject for a discussion.

Will property previously waived (in the Extrajudicial Settlement of Estate) by the children in favor of co-heir mother still be inherited by the children when the mother passes away?

Point to consider:
It was already previously waived by the children in the EJS, so titles were issued in the name of the mother.

Will the previous waiver bar the children from inheriting the properties again? Inputs?

Smile

I haven't read that law, but I suppouse it just mean the kids let the mother get whole as long as she is alive, and then the kids inherit the property from her - if she has kept it Smile

Reclusion Temporal

I think the waiver wont bar the kids from inheriting the same property, because they still have the right to inherit.
