probationary employee po ako. nag file po ako ng resignation just less than a month before I ended my contract. They agree (verbal) na allow akong magresign na hold lang ako for a week, for my clearances and to finish some of my work. Now i did look for a new job (new company) and a possibility that they will hire me. My employee now wants me to waived my 13th month pay in exchange of allowing me not to render the 30 day holding period.

Is this legal? on the first hand they agree that I only render a week of holding period though it is a verbal agrement.

ano po ang pwede kong gawin. malaking tulong po sana sa akin yung 13th month po na yun.

this is illegal, tell them magrereklamo ka sa dole pag tinuloy nila..

That is not allowed. If they agreed that they allowed you to resign in less than 30-days, make sure they have accepted your resignation. If they want to claim damages from you for not rendering 30-days, they have to file it in court.
