Good day po.

Kami po ay mga regular na teacher sa isang private school. Apat po sa aking mga kasama ang hindi binigyan ng kopya ng kanilang appointment and contract as regular. Lima hanggang walong taon na po kaming nagtatrabaho doon.
Last January po sinabihan kami at pinipilit na magresign nlng kami. Hindi po kami pumayag. Pinaglalaban po namin ung aming termination pay.
Kaninang umaga po eh hinahanapan kami ng kopya ng appointment at contract as regular ng aming principal at directress. Eh hindi naman po sila nabigay ng kopya( meron po pinirmahan ang mga coteacher ko dati na appointment at contract datipero wala silang kopya).

the contract is actually needed to establish your case, since they did not gave you, we need to have other evidences to prove that you really have worked in that private school. 1 way is your payslip in that school every time you receive your monthly salary.

Your case should be also in the NRLC where the school is located. Before bringing your case, secure first the evidences that you would need, since, once it will be in the knowledge of the school, you will be having a hard time securing evidences

Employment contracts are not conclusive as to proving employer-employee relationship, as held by the Supreme Court in many labor cases regarding that.

If your employer exercises control over you, pays out your salary, and provides rules and regulations as to the standard of teaching, then you are considered as a regular employee.

Your employer wants you to resign kasi gusto nilang mawala yung karapatan nyo for separation pay. Sa Labor Code natin kasi, once you resigned, the separation pay is deemed waived. Kaya wag kayong magresign unless ayaw nyo na rin talaga.

Your employer may only terminate you for just grounds as provided for in the Labor Code. Kung wala syang basehan kung bakit nya kayo pinapagresign, then you guys have a right to stay lalo na kung ginagawa nyo naman yung trabaho nyo as teachers.

Keep every document/payslip that you have. Kung magkakaroon ng kaso, marami pa namang paraan para maprove na nagtrabaho kayo sa school na yun, through the students' and parents' testimonies as well as the other employees.

Thanks po nang marami... meron po kaming problema ngaun... dahil sa gusto nilang makatipid sa dapat nilang ibayad sa separation at premium pay namin ... eh kung kanikanino na po sila nag sasabi at nagtatanong... mostly matataas na official ng DepEd(un po ang sinasabi nila sa ibang teachers) pati po ung mga principal ng ibang private school. Eventually makakasira sa pag aapply namin sa public school at sa ibang school. Anu po kaya ang pwede naming maging hakbang.
