Arresto Menor

During SENA, two persons pretending to be employees were asking for huge amounts (300k) for payment. But since they are not employees of this small company (and the amount is too big), no settlement was made. These persons then filed to the next arbitration.

Question is can extortion be charged by a company to nonemployees who filed illegal dismissal, non payments of benefits, attorney's fees? If not, what case/s can be charged to these persons?

U may just add that to ur answer that they are not employees and damages may be asked for that for the hassle, sleepless nights, atty's fees and other fees incurred therefore. If it is proven after trial that they are not really employees, malicious prosecution case may be filed.
