Hi, good day! bago lang po ako sa website na to at need ko po ng advice ninyo. I am employed sa isang company at yung process (work activities) ng team namin ay unti unti nang ma-migrate sa ibang bansa (meaning may iba ng magtratrabaho na based sa ibang bansa) kaya madi-dissolve na ang Team namin sa department na kinabibilangan namin. Now, ung mga Senior Team manager naming at operation manager eh sinasabihan na kaming maghanap (mag apply) ng ibang trabaho (sa ibang department within the company through internal hiring) Kaso lumipas na ang 1 month at 10 days (as of this time) at wala pa ako nalilipatan (although nag aapply ako sa ibang department kaso nde pa pinapalad na matanggap. (gusto ko kasi yung lilipatan kong department eh aligned sa experience ko at yung gusto kong gawin)

We have recently meeting with HR manager at sa mga Managers namin to address yung mga questions namin. I remember may nagtanong ba kung may redundancy pay bang I-ooffer, Management said na nde nila tinitingnan ung option na yun kasi confident sila na made-deploy kami sa new department/ work namin.
Naitanong din during discussion was, "paano kung wala pa ding mahanap ang isang employee ng gusto nilang work and HR said na pag may vacant sa ibang team sa original department namin doon daw kami I-deploy. (FYI, sa department namin kasi ay may almost 6 different teams with different process) Eh ang problema is ayaw ko na sa department namin kaya tumitingin ako sa ibang department pra sa ibang process at career growth.
HR manager also told us na, pag nagka vacant sa ibang team within our department eh hinde na daw iooffer yung work samin, kundi assignment na agad (meaning ala ng chance tumanggi)

Yesterday, pinatawag ako ng isang Senior Team Manager at kinausap ako na may bakante daw sa isang team sa department namin, at sinabi nya sakin na iassign daw ako dun, (ayoko na kasi sa department namin at kino-consider ko ang ibang department) at ini-insist nia na assignment un at nde offer (meaning wala akong karapatang tumanggi) sinabi ko sa kanya na ayaw ko na tlga sa department nmin at nde ako makakapag perform ng maayos kc hindi ko din kc linya ung ina-assign na work

Question ko po..
1.) May legal ba po bang basehan kong tatanggihan ko yung assignment na sinasabi sakin ng Senior Team Manager? na in the first place, nde nman nmin ginusto madissolve yung team nmin at mawalan ng trabaho (floating)?
2.) Legal po ba yung action na gagawin ng management na ilagay kami sa new team na nde namin gusto? (not aligned with my career at experience) na alam ko na nde ako mag eexcel.
3.) Ano po ba ang mga karapatan ko na dapat kong ipaglaban?

1. Wala.
2. Yes. Binibigyan ka ng trabaho, at matututunan mo din naman siguro ang mga gawain doon.
3. Wala.

Bottom line sa ganyan, kung ayaw mo sa trabaho na binibigay sa iyo, at hindi naman illegal ang pinapagawa, pwede ka naman mag-resign.

Gaya nga ng sabi ni Council, management prerogative kasi yung power ng employer mo para i-assign ka sa different areas ng company as they see fit. Only if there is substantial proof that there was gross negligence or any malicious intent in assigning you to such area will their decision be possibly challenged in court. Nasa labor code yun, and maraming cases na decided na ng Supreme Court ang nagpapatunay ng validity ng management prerogative.

Valid ang reassignment mo, in short. Remedy mo na lang nyan kung ayaw mo talaga yung work is for you to give notice to your employer 30 days before your planned resignation.

Pero if ang assignment is not something u can do or learn to do, or will just cause you to become ineffective in any way because u do not know how to do it, constructive dismissal yan.

Isa yang pamamaraan ng pagdidismiss ng isang empleyado na hindi direkta ang pagkasabi. Illegal dismissal pa rin yan. Minsan kasi sinasadya nilang gawin yan para kapag di ka na epektibo sa trabaho mo pwede ka na nilang tanggalin kasi may rason na sila.
