Eto po ay problema ng ate ko pero i feel so stressed and i wanna help her out kaya lang sobrang laki na ng utang nya sa mga tao. Madami syang inutangan at lahat 10% walang kasunduan o pirmahan. Just recently na find out namin sobrang laki na umabot na mahigit milyon sa tagal na panahon na at hindi kaya ng kita tubo pa lang. i would say nakailang fold na ang balik ang capital nila. Ngayon po baon na baon na sya, kami din baon na din syempre tinulungan namin sya sa abot ng aming makakaya pero sa laki na ng utang nya di namin kayang bayaran lahat. I am wondering is there any way ba na yong mga nautang nya ay pwede ng di na bayaran since nakailang doble naman na ang capital non? There is no such thing as filing bunkruptcy in Philippines right? Madami po ang nautangan nya. Meron pang isa na lagi syang tinatakot sending threat messages kasi gusto buwan2 magbayad sya kahit sa pohonan na lang kaya lang sa dami nila di sapat ang kita. Pwede ba syang makulong dahil dito pag iaabot na to sa korte? Salamat po hoping to get advices from here kasi im so stressed.

Your sister cannot be detained or jailed dahil sa utang, kasi civil case lang ang pwedeng maifile sa kanya. Criminal case dapat yung nature ng kaso para makulong sya, according sa batas natin.

That being said, she has to pay her debts in accordance with the agreed-upon interest rate. It is possible to contest the validity of the interest rate kung masyadong mataas. Pero sa korte lang magagawa yun and yung judge yung magdedesisyon kung masyadong mataas yung interest rate or not.

You may want to look into the Insolvency Law in the Philippines, since this seems to be the applicable law for your sister. Try to get free legal advice from the Public Attorney's Office nearest to you para makakuha kayo ng bird's-eye view on what you and your sister should do to fix those debts.
