I was employed for more than 6 years in my recent company from 2009-2015.
I planned to file a month of leave to my employer due to family reasons and they only allow me for a week and used it and tell them that i truly need a month of leave due to processing of migration. After a week of leave, HR head tells me that i will be AWOL if not return to work after a week of leave and 4 days of absence. HR head asked for a conference and they tell me that its better to file a resignation than to file a month of leave.
I did what they tell and filed an immediate resignation that will not render 30days as usual separation steps for clearance and because the BOSS of the company tells me also that i may get a separation pay from her own pocket just to comply what the company needs. The company wont give any separation to me because that is setting a precedent and it wont have a policy for that as per my BOSS and according to them that its not an obligation after all.
Now that i already comply, my BOSS and HR management are now ignoring my messages and calls for my follow-ups of separation pay.
My relatives and friends tells me to file a labor case regarding this but do i have a guarantee to win a case?
