Good day,
I've been working at this company for a little over a year. Before the holidays, feeling stressed I decided to take a day off. I texted my employer but I had no valid reason to say but I did mention about my intention to speak with her the next day. She replied that she wanted to talk now. She called and I told her of my plan to resign. She told me she would not accept my resignation. I am currently working on a project and she wants me to finish them. But the problem is nawalan nako ng gana magwork for them. If started when the president of the company which is her father called me "stupido". Plus there are lot more reasons why I don't want to stay any longer. We work 10 hours a day plus 3 more hours on saturdays. That's more than the regular hours. The extra hours, as far as I know is considered over time. The thing is they don't pay for overtime. My employer even threatened me to file a breach of contract of I insisted to leave. And that instead of the 30 days, I needed to stay 90 days more after I file the resignation. I'll post a copy of what's written on my contract if any one care to review it. I really want to leave this company. I hope someone can give me good advice. Thanks in advance.

Base on what u said, the company already violated the labor. On your part, since there is still no formal resignation made by you, there is no breach of contract. Just file your resignation 30 days before resigning, depending on the terms of ur contract, u may be compel of what is written in the contract, except provisions that force u to work, since involuntary servitude is guaranteed by our constitution
