Cohabitation, Legally separated

Can a legally separated woman, cohabitate with another man legally?

I'm not 100 % sure, but as I have understood it, you need an ANULMENT to make it legal.
Or be widow/widower, but it isn't legal to murder to become that

Well that never even crossed my mind. Annulment is the only way I guess. I might have to end this relationship.

My murder coment was just a joke
but some become widow of other reasons too.
I BELIEVE an other option is IF the other is at unknown location, unknown if being alive several YEARS (7 ?) and by that become COUNTED as dead. although it isn't known if dead or alive.

If your live in partner is foreigner, I BELIEVE that can even be a DEPORTATION reason for him.
End or "put on hold" the new relation until the old marriage is solved.

I'm the foreigner. My GF is a PNP officer. She is the one legally separated. I am unmarried.

I see. If I have understood corect. you BOTH make a crime living together, and for us foreigners we can become deported too.
It's an other question if someone bother to report it. Many Filipinos live together although they are married/separated to someone else, but we foreigners are more vulnerable. because of the deportation risk.

Hello. One of the effects of Legal Separation is to enable them to live separately from one another (See Art. 63 (1) of the Family Code). What Lunkan may be referring to is the possibility of you and the woman of being charged for adultery. While I am not 100% sure, i believe that the grant of legal separation equates to "permission" given by the other spouse to have intercourse with another. As for civil liability, I cannot really say. The situation you are having with the woman may be shocking to the morals of most Filipinos.

But I have wonn rather many cases in my home country for myself and clients. even against the government.

Since two years I have been studying the Philippines including the laws, which can concern me settling and start business there So I have studied mainly Philippine business, tax and property laws, but a litle family laws too.
So far no one has corected me corect* except once I had read a VISA law, thought it was valid still, but it had been replaced recently.

Hello good day!.....need help.....
Me and my husband is not married living together 20 years now we have a child 19yrs old.....we have been living together as a husband and wife that encounters problems and i thought that was normal.....only this last 6 years of being together flirting to other woman especially to his student (he is working in school) was our main issue which i have caught that he really got relationship withto his student who had just graduated ....it is been our battling problem to the point he hit me and hurt me physically and he kept on denying his relationship.... To the point that i even had talk to the girl and told the what she is doing is wrong that he is entering in a relationship with a family man.and when i can't stop them i even talk to the father of the girl that his daughter is having an affair to a family man ......then what i have done was'nt enough to stop them...until the girl got pregnant and the child is a month old now....

Pls help me can i file a case to the girl who interfer our life knowing that the man he got with is a family man and cohabitating together for 20 years.....and to my husband is there any case that i can file also....i still feel betrayed and shameful to what happened to my family espicially for my child...

If you had been married, then the SEX would have been a crime in the Philippines both by the man and the girl,
but by you aren't married they have "only" been immoral.

BUT the red marked is a crime. Try to get evidience as doctor report, photographs, witnesses...

I was (de facto) separated with my legal wife and live with a woman with the same situation like mine but later her husband died while we were living together. Now, we are planning to terminate our cohabitation, but the problem is that we have acquired real properties and personal properties like vehicles. How can we divide the acquired properties during the time that we were living together? Thank you to much for your immediate response.

Living together with an other when you are separated is seen as a crime in the Philippines,
so you better NEGOTIATE how you split your assets and "buy/sell" them between youself - or sell to other and split the money - as if you hadn't ever been living together.
If you want, you can use the law how married split assets as "inspiration" when you discus how to split things.

It was signed by both parties and with two witnesses. Please help me on what measures to take so we can be married.

They CAN'T do the red mark just by thenselves, because if they get other then they BREAK THE LAW in the Philippines. (Adultery/concubinage.)

There are different steps:
1/ Only decide what they find ok between THEMSELVES. ( =What they have done it seem if they haven't forwarded it to get step 2.)
2/ LEGAL separation. (=Separate ECONOMY and are no longer responcible if the other mess up, but they CAN'T still get other partner.
3/ END the marriage by annulment.
