Im 29, got kids 5 and 8 years old.. hindi po kami kasal ng ama ng mga anak ko at hiwalay na po, lumaki po ang mga bata na lola(tiya ng ama) nila ang nag alaga sa kanila dahil po nagtatrabaho ako pero umuuwi parin ako sa kanila every 1 or 2 months ganun din po ang ama nila. May karelasyon narin po ako at meron narin ang ama nila. Gusto ko na po kunin ang mga anak ko pero ayaw ng ama nila. Ano po ang karapatan ko bilang ina para sa custody sa mga anak ko.

custody of an illegitimate child/children belongs exclusively to the mother - Yan ang right mo, now, kunin mo physically yung mga bata, walang makakpigil sayo kahit magsampa pa ng case tatay ng bata.

Doesnt matter kung ilang taon ung bata? Kasi sabi nila pag more than 7 years na ung bata na ang magdedecide kung kanino nya gusto sumama...

Age ng bata doesn't matter kasi you were not legally married.

its on jurisprudence, just search custody of an illegitimate child. Further, Art. 176 family code. The term parental authority of the mother is also construed as sole custody by the mother.

hello po... meron po akong 3yrs old na anak... unmarried po ako sa tatay ng anak ko. ngsama po kami ng 8years sa isang bubong. Ngayon po, nagkahiwalay kami.. iniwan nia kami ng anak nia para sa babae nia. Kinokontak ko po sia para hingan ng sustento ung anak ko.. pero hindi na po sia ngpaparamdam. ano po ba dapat kong ifile para magkaron kami ng fix arrangement para magkaron ako ng laban para sa sustento nia sa anak ko. salamat po in advance.

Hi, my son (of Filipino mother/ Australia father) went home to PI and got a girl pregnant. He's been informed that the child's due birth date is June 2017. What are his legal rights with regards to the child's custody if the mother is willing to give up the child as she is unable to care for the child? Is he allowed to bring the child to Australia or does he have to adopt the child before he can take care of his child? Anybody knows where he stands regarding this issue?
