Hi,

my child was born before me and my wife got married. We didnt do the legitimation process then. Me and my wife has been separated for about 10 yrs now and im taking care of my kid. How am i able to do the legitimation process without her mother because we dont know where she is right now.

Do you mean the birth certificate say "father unknown" or what?
Or no birth certificate at all?

She is using my surname i signed the acknowledgement of paternity when she was born.

Your child cannot go through the legitimation process without your wife's signature on the affidavit of legitimation. Have you thought about your objective why you want to formally legitimize your child? There isn't much difference anyway, unless you are considering having another family/kids -- possible issues on succession and estate distibution.

The main reason is i want to get a passport for her but the requirement is if shes illegitimate the mother needs to apply for her.
