Hi! may anak po ako, 6 years old. Hindi po kami kasal ng daddy niya and sa kanila po kami nakatira. Naghiwalay po kami, 1 year na po. Nasa kanya po ang bata dahil ayaw niyang ibigay sa akin. Para po walang gulo at hindi ma-stress ang bata ay hinayaan ko po munang doon siya magstay sa dad niya dahil siya din ang nagpapaaral ngayon sa anak namin at nung mga time na naghiwalay po kami ay nag-aaral po ako. Wala po akong work nagyon pero sustentado po ako ng both parents ko na nasa abroad. Wala pong problem financially. Tanong ko lang po kung pwede ko pong makuha yung full custody ng anak ko? Kahit yung daddy po ang nagpapaaral at nagsusustento sa lahat ng kailangan ng bata? Dahil sinubukan ko na pong kunin dati yung anak namin pero ayaw ibigay sa akin dahil wala daw akong karapatan dahil hiniwalayan ko daw siya. At makakaapekto po ba yung pagkakaroon ko ng bagong boyfriend para hindi makuha ang full custody ng anak ko? Thanks!

Anak mo yun, bakit hindi? Sa batas natin, ikaw ang nararapat na magkaroon ng full custody at parental authority sa anak mo.

Oo. Nasa iyo man ang bata, obligasyon pa din ang tatay na magpadala ng sustento para sa bata kung ayaw niyang makasuhan siya.

Dahil sinubukan ko na pong kunin dati yung anak namin pero ayaw ibigay sa akin dahil wala daw akong karapatan dahil hiniwalayan ko daw siya.

Mag complain ka court para sa full custody. Kumuha ka ng abogado

At makakaapekto po ba yung pagkakaroon ko ng bagong boyfriend para hindi makuha ang full custody ng anak ko?

An other question is - What's best for the CHILD?
How long time has it been with the father?
If long time, it can be best for the child to stay where it's used to be, but meet and visit you ALSO.

1 year but I always visit our son and stays with me during weekend. what I just want is to have the full custody.

Normaly the mother get the custody when the child is under 7,
but I don't know if the justice find it different by the child have lived with the father a year.

it's because he didn't allow me to get my son that's why I am asking now here if there is a chance I could be able to my son and I most of the articles I've read that has the same issue as mine, the mother has the most rights in terms of full custody no matter how long the child/children had stayed with the father especially when the parents are not married.

It's a not about the chance, it is a Family Code, I think Article 176. So you should get your atty to file your petition. The mother should have full custody and full parental authority over the illegitimate child unless court finds compelling reasons to take away the illegitimate child from the mother.

The father of the illegitimate child can then ask the court for his visitational rights over the child with your full consent. Sa iyo pa nga magpapa alam kung payag ka sa requested na araw o oras na hinihinling ng ama ng bata. Father may also ask temporary custody of the child in court on special or regular occasions, with the mother's consent approved by court.

tabong ko lang po..may napagkasunduan po kami sa PAO na dapat po siyang magbigay ng 4k buwan-buwan pro mula nung sept hanggang ngayon wala po siyang binigay..base po sa pagpunta ko po sa VAWC aftr 3 months pa daw po na walang maibigay ang ama ng ex ko po base sa napagkasunduan sa PAO saka pa lang daw po aq pwd magfil sa VWAC..gnunn po b tlg un?

Mawalang galang po sana, this is not about what you want or what you are after to. Huwag po nating kalimutan na IT IS about the rights and welfare of the child. The child has rights to receive financial support from the father for his proper growth and extra sustenance.

Kailangan ng bata na makita din at madama ang kanyang ama para magkaroon siya ng "fatherly" image na makakatulong sa kanyang pagkakilala sa sarili, pagkatao at tamang paglaki (mental, psychological, emotional etc etc.) Sana po ay ibigay din natin ito sa bata. GL po
