Do I have a right on the road just before my property? cause: clogged drainage

I live in a subdivision in the city. Our street is slightly sloped down. The drainage at the upper portion of our street is clogged, making it overflow and the sewage water flow on the road, affecting the front road of all property owners of townhouses living downstreet in that road. It was very annoying as there is grime and moss build-up just in front of our gates. I have 2 questions:

1) who is liable for having the clogged drainage fixed? is it the developer? the home-owners association or the property owners affected by the overflowing drainage? Note: the property owners affected live downstreet the affected clogged canal. It so happened that by gravity, all the overflowing sewage water flows to our area. but the clogged portion is way upstreet.

2) a neighbor of mine who lives farther down the street put a "cement barrier" just in front of my gate. She did this so that the water won't flow going towards her property. Do I have the right to remove this small cement barrier which creates a larger pool of stagnant water just in front of my gate? Does she has the right to install that cement barrier in front of my property?

I hope I can get some legal advise, just for me to be aware of what my rights as a property owner are. Thank you!

im not legal knowlegable but i can have some opinions..is the barrier youre neigbor put it inside youre property you can remove it it think because its in youre property. but if the problem is outside youre property you can report it inyoure authority...question who is the authority?
